COURTS.  Authorizes the Twenty-Third JDC to adjust bail amounts for cash. (8/1/12)
AN ACT1
To amend and reenact Code of Criminal Procedure Art. 324(A)(3), relative to bail in2
criminal matters; to authorize the Twenty-Third Judicial District Court to alter the3
percentage amount of bail to be deposited; to authorize the collection of an4
administrative fee for processing such bond; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. Code of Criminal Procedure Art. 324(A)(3) is hereby amended and7
reenacted to read as follows: 8

A.(1) *          *          *10
(3)(a) The court in the parishes of St. John the Baptist and St. Charles, by11
written rule, may alter the percentage amount of bail to be deposited with the officer12
authorized to accept the bond and authorize the officer to charge an administrative13
fee, not to exceed fifteen dollars, for processing the bond.14
(b) The Twenty-Third Judicial District Court, by written rule, may alter15
the percentage amount of bail to be deposited with the officer authorized to16

to exceed fifteen dollars, for processing the bond.1

DIGEST
Present law provides for the methods by which bail in criminal cases may be undertaken,
bail through surety of cash deposits or bail without surety.
Present law authorizes courts in the parishes of St. John the Baptist and St. Charles, by
written rule, to alter the percentage amounts of cash deposits for bond. Present law further
authorizes such courts to charge an administrative fee of not more than $15 for processing
such bond.
Proposed law retains present law and extends same authorization to the 23
rd
 JDC to alter the
percentage amounts of cash deposits for bond and authorizes the collection of the $15
processing fee for such bond.
Effective August 1, 2012.
