Regular Session, 2012 SENATE BILL NO. 497 BY SENATOR MORRELL PUBLIC SFTY/CORRECT DEPT. Repeals the statutory authority for the Louisiana Risk Review Panel. (8/1/12) AN ACT1 To repeal R.S. 15:308(C) and 574.22, relative to the Louisiana Risk Review Panel; to repeal2 the statutory authority for the panel; and to provide for related matters.3 Be it enacted by the Legislature of Louisiana:4 Section 1. R.S. 15:308(C) and 574.22 are hereby repealed. 5 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Cathy R. Wells. DIGEST Present law provides for the risk review panel within DPS&C. Further provides for the composition and duties of the panel. Present law requires the risk review panel to evaluate the risk of danger to society posed by each person convicted of a crime who is confined in a prison facility if released from confinement. Present law excludes the following persons from this evaluation by the panel: 1. A person convicted of a crime of violence. 2. A person convicted of a sex offense when the victim is under the age of 18 at the time of commission of the offense. 3. Certain controlled dangerous substance violations. A person sentenced as a habitual offender where one or more of the crimes for which the person was convicted is a crime of violence. Proposed law repeals present law. Effective August 1, 2012.
