MENTAL HEALTH.  Establishes a special fund in the state treasury for the deposit of
certain savings derived by the state from the Louisiana Behavioral Health Partnership and
the Coordinated System of Care. (7/1/12)
AN ACT1
To enact R.S. 39:100.52, relative to state funds; to establish the Mental Health Services2
Access and Improvement Fund; to provide for the deposit of certain monies into the3
fund; to provide for the uses of monies in the fund; to provide for an effective date;4
and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 39:100.52 is hereby enacted to read as follows: 7
ยง100.52. Mental Health Services Access and Improvement Fund8
A. There is hereby established in the state treasury, as a special fund, the9
Mental Health Services Access and Improvement Fund, hereinafter referred to10
as the "fund".11
B. The source of monies deposited into the fund shall be any monies12
realized as a result of cost savings attributed to the implementation of the13
Louisiana Behavioral Health Partnership and Coordinated System of Care14
administered by the Department of Health and Hospitals (DHH), or any other15
monies which may be provided by law. The Department of Health and Hospitals16
shall certify to the Joint Legislative Committee on the Budget by May fifteenth17 SB NO. 537

each year the amount of any savings projected to be realized by the end of that1
fiscal year as a result of the implementation of the Louisiana Behavioral Health2
Partnership and Coordinated System of Care available to be deposited into the3
fund.4
C. All unexpended and unencumbered monies in the fund at the end of5
the fiscal year shall remain in the fund. The monies in the fund shall be invested6
by the state treasurer in the same manner as monies in the state general fund,7
and interest earned on the investment of monies shall be credited to the state8
general fund.9
D. The monies in the fund shall be appropriated and used solely to fund10
the enhancement of mental health services provided across the state.11
Section 2. This Act shall become effective on July 1, 2012; if vetoed by the governor12
and subsequently approved by the legislature, this Act shall become effective on July 1,13
2012, or on the day following such approval by the legislature, whichever is later.14

DIGEST
Proposed law establishes the Mental Health Services Access and Improvement Fund as a
special fund in the state treasury.
Proposed law provides that the source of monies deposited into the fund shall be any monies
realized as a result of cost savings attributed to the implementation of the Louisiana
Behavioral Health Partnership and Coordinated System of Care administered by the
Department of Health and Hospitals (DHH), or any other monies which may be provided by
law. Provides that DHH shall certify to the Joint Legislative Committee on the Budget by
May 15th each year the amount of any savings projected to be realized by the end of that
fiscal year as a result of the implementation of the Louisiana Behavioral Health Partnership
and Coordinated System of Care available to be deposited into the fund.
Proposed law further provides that monies in the fund shall be appropriated and used solely
to fund the enhancement of mental health services provided across the state.
Effective July 1, 2012.
