AN ACT1
To amend and reenact R.S. 40:1730.42 and 1730.45(A) and (B), relative to the state fire2
marshal; to provide for definitions; to provide for enforcement and rules; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 40:1730.42 and 1730.45(A) and (B) are hereby amended and6
reenacted to read as follows: 7
§1730.42. Definitions8
(1) "Alteration" means alterations or repairs to existing buildings in9
accordance with R.S. 40:1574(C), (D), (E), (F), and (G).10
(2) "ANSI/ASHRAE/IESNA 90.1- 2004", or the latest edition adopted by the11
state fire marshal, pursuant to the provisions of the Louisiana Administrative12
Procedure Act, means the document developed by the American National Standards13
Institute, American Society of Heating, Refrigerating, and Air Conditioning14
Engineers, and the Illuminating Engineering Society of North America entitled15
"Energy Standard for Buildings Except Low-Rise Residential Buildings".16
(3) "Commercial buildings" means all buildings designed for human17
occupancy except one- and two-family dwellings.18
(4) "EPAct" means the Energy Policy Act of 1992 enacted by the Congress19
of the United States, as amended.20
(5) "Historic buildings" means those buildings specifically designated as21
historically significant by the state historic preservation officer or by official action22
of a local government.23
(6) "International Energy Conservation Code, 2006 edition" or the latest24
edition adopted by the state fire marshal, pursuant to the provisions of the Louisiana25
Administrative Procedure Act, means the document developed by the International26
Code Council, Inc., entitled "International Energy Conservation Code", also referred27

to as "IECC".1
(7) "Repair" means alterations or repairs to existing buildings in accordance2
with R.S. 40:1574(C), (D), (E), (F), and (G).3

§1730.45. Adoption of Commercial Building Energy Conservation Code;5
enforcement; rules6
A. ANSI/ASHRAE/IESNA 90.1- 2004 2007, or latest edition promulgated7
by the state fire marshal, with state amendments, is hereby adopted as the8
Commercial Building Energy Conservation Code for applicable buildings.9
B. The International Energy Conservation Code, 2006 2009 edition, or latest10
edition promulgated by the state fire marshal, with state amendments, is hereby11
adopted as the Commercial Building Energy Conservation Code for applicable12
buildings not covered by the preceding part.13
