ATTORNEYS. Provides relative to appointment of an attorney to represent a public
institution of postsecondary education in connection with an intellectual property matter.

AN ACT1
To enact R.S. 49:258(4), relative to contracting with a private attorney to represent a2
Louisiana postsecondary educational institution in connection with an intellectual3
property matter; to provide an exception from certain procurement procedures; and4
to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 49:258(4) is hereby enacted to read as follows:7
ยง258.  Procurement of private contractual legal services for state agencies8
Notwithstanding the provisions of any other law to the contrary and9
specifically the provisions of any law that authorizes the state or a state agency to10
appoint, employ, or contract for private legal counsel to represent the state or a state11
agency, including but not limited to the provisions of R.S. 42:261, 262, and 263, and12
R.S. 40:1299.39(E), any appointment of private legal counsel to represent the state13
or a state agency shall be made by the attorney general with the concurrence of the14
commissioner of administration in accordance with the following procedure:15

with an attorney to represent a Louisiana postsecondary educational institution1
in connection with an intellectual property matter. 2

DIGEST
Present law provides that, to contract for private legal counsel for a state or state agency,
such legal counsel must be appointed by the attorney general with the concurrence of the
commissioner of administration in accordance with certain procedures.
Proposed law provides that exception for the appointment of an attorney to represent a
Louisiana postsecondary educational institution in connection with an intellectual property
matter. 
Effective August 1, 2012.
