EMPLOYMENT.  Provides relative to the employment of minors. (8/1/12)
AN ACT1
To amend and reenact R.S. 23:151 and 183, relative to the employment of minors; to2
provide for certain exceptions; to provide for employment certificates; and to provide3
for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 23:151 and 183 are hereby amended and reenacted to read as6
follows:7
§151. Application of provisions8
The provisions of this Part shall not apply to minors employed in agriculture,9
domestic services in private homes, nor shall they be construed as conflicting with10
any laws requiring minors to attend school. Relief from the disabilities which attach11
to minority shall not in no way defeat the protections extended by this Chapter to12
persons under the age of eighteen.13

§183. Persons authorized to issue15
A. Employment Except as provided in Subsection B of this Section,16
employment certificates shall be issued by 	any of the following:17 SB NO. 612

(1)  the The parish or city public school superintendent or by his or her1
designated representative.2
(2) By the principal of a public or private school or by his or her3
designated representative.4
(3) By a parent or legal guardian if the student is a home study program5
participant. 6

and each year thereafter, employment certificates need only be signed by a8
parent or legal guardian.9

executive director of the Louisiana Workforce Commission. The superintendent or11
his designee must completely fill out and electronically submit the Employment12
Certificate Interactive Form located on the Louisiana Workforce Commission's13
website. The employment certificate shall be printed online from the website from14
the information that has been entered onto the department's employment certificate15
database. The original employment certificate shall be signed by the minor and the16
issuing authority and presented to the minor for delivery to his or her employer.17

Present law restricts the employment of minors except in cases where the minor is employed
in agriculture or as domestic servants in private homes.
Proposed law retains present law but clarifies that relief from the disabilities which attach
to minority shall in no way defeat the protections extended to persons under the age of 18.
Present law provides that, when certain minors are employed, employment certificates will
be issued by the parish or city school superintendent or by his or her designated
representative. Present law further provides that the names of the minor employee shall be
submitted in writing for approval to the executive director of the Louisiana Workforce
Commission. Present law further provides that the superintendent or his designee must
completely fill out and electronically submit the Employment Certificate Interactive Form
located on the Louisiana Workforce Commission's website.
Proposed law retains present law but adds a principal of public or private schools, or his or
her designee, to the list of those who are authorized to issue the employment certificate.
