SENATE BILL NO. 621
BY SENATOR MURRAY 
CIVIL PROCEDURE. To provide relative to the Municipal Court and Traffic Court of New
Orleans and certain court fees and salaries.  (8/1/12)
AN ACT1
To amend and reenact R.S. 13:2497 and 2500.2(A)(1), and to repeal R.S. 13:2500.3, to2
provide relative to courts and judicial procedures; to provide relative to the3
Municipal Court and Traffic Court of New Orleans; to provide relative to certain4
court fees and salaries; to remove reference to specific dollar amounts of salaries for5
certain deputy clerks of the Municipal Court of New Orleans; to provide for an6
increase in certain fees collected by the Municipal Court of New Orleans; to repeal7
authority of the Municipal Court and Traffic Court of New Orleans to collect bail8
bond fees; and to provide for related matters.9
Be it enacted by the Legislature of Louisiana:10
Section 1. R.S. 13:2497 and 2500.2(A)(1) are hereby amended and reenacted to read11
as follows:12
§2497.  Deputy clerks; appointment; salaries; removal 13
The clerk of the municipal court of New Orleans shall appoint such deputies,14
assistants and employees as the legislature may provide. There shall not be less than15
twenty deputy clerks and other employees of the court, and their salaries and manner16
of appointment and removal shall be as hereinafter designated.17 SB NO. 621

The following named deputy clerks of the municipal court of New Orleans1
shall be appointed by the chief clerk of the court, who may remove any of them at2
any time, and their salaries are hereby fixed as follows: one chief deputy clerk at a3
monthly salary of three hundred dollars; four criers at a monthly salary of one4
hundred seventy-five dollars each; one deputy clerk, known as a bond clerk, at a5
monthly salary of one hundred seventy-five dollars; two deputy clerks, known as6
capias clerks, at a monthly salary of one hundred seventy-five dollars each; three7
deputy clerks, known as docket clerks, at a monthly salary of one hundred8
seventy-five dollars each; one deputy clerk, who shall do the stenographic work of9
the clerk's office, at a monthly salary of one hundred seventy-five dollars; one deputy10
clerk, known as cashier, at a monthly salary of one hundred seventy-five dollars; one11
deputy clerk, known as dock man in charge of the prisoners, at a monthly salary of12
one hundred seventy-five dollars; one deputy clerk, known as parole clerk, at a13
monthly salary of one hundred seventy-five dollars.14
All salaries of the clerks and deputy clerks of the municipal court of New15
Orleans shall be paid by the city of New Orleans.16

§2500.2.  Additional court costs to defray expenses18
A.(1) In all cases over which the Municipal Court of New Orleans has19
jurisdiction, there shall be taxed as costs against every defendant who is convicted20
after trial or after he pleads guilty or who forfeits his bond a nonrefundable sum of21
fifteen thirty dollars, which shall be in addition to all other fines, costs, or forfeitures22
lawfully imposed.23

Section 2.  R.S. 13:2500.3 is hereby repealed in its entirety.25 SB NO. 621

DIGEST
Present law provides relative to Municipal Court and Traffic Court of New Orleans.
Specifies position titles and monthly salaries of various deputy clerks in the Municipal Court
of New Orleans. 
Proposed law removes references to specific salaries and retains present law requiring that
there shall not be less than 20 deputy clerks and other employees of the Municipal Court of
New Orleans, and that all salaries of the clerks and deputy clerks of the Municipal Court of
New Orleans shall be paid by the city of New Orleans.
Present law provides that in Municipal Court of New Orleans cases in which a defendant is
convicted after trial or after he pleads guilty or who forfeits his bond, the Municipal Court
of New Orleans shall tax as costs a nonrefundable sum of $15, which shall be in addition to
all other fines, costs or forfeitures lawfully imposed.
Proposed law increases sum from $15 to $30.
Present law provides for the Municipal and Traffic Courts of New Orleans to impose a bail
bond fee on each bail bond issued and on persons released on their own recognizance by an
elected official.  Present law further provides for the amount, manner and procedures for
collecting such bail bond fees.
Proposed law repeals present law. 
Effective August 1, 2012.
