AN ACT1
To amend and reenact R.S. 33:4574.1.1(P) and 4577(C)(2), to enact R.S. 33:4577.1 and to2
repeal R.S. 33:4577, relative to the Beauregard Parish Covered Arena Authority; to3
provide for board powers and duties; and to provide for related matters.4
Notice of intention to introduce this Act has been published.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 33:4574.1.1(P) and 4577(C)(2) are hereby amended and reenacted7
and R.S. 33:4577.1 is hereby enacted to read as follows:8
§4574.1.1. Occupancy taxes levied by the commissions9

P. If the Southwest Louisiana Convention and Visitors Bureau levies the tax11
authorized in Paragraph (A)(25) of this Section and/or or the tax authorized by R.S.12
33:4574.11(A) and defined in R.S. 33:4574.11(E)(2)(b), an amount equal to13
twenty-five thousand dollars annually of the proceeds of the tax collected from the14
company which has a license to conduct slot machine gaming at a pari-mutuel live15
racing facility pursuant to Chapter 7 of Title 27 of the Louisiana Revised Statutes of16
1950, R.S. 27:351 et seq., shall be provided by the Southwest Louisiana Convention17
and Visitors Bureau quarterly to the governing authority of the Beauregard Parish18
Covered Arena, Authority provided such funds are used for maintenance or to19
promote equine activities for the purpose of attracting tourists to Beauregard Parish.20
The governing authority of the Beauregard Parish Covered Arena Authority, which21
is subject to audit by the legislative auditor, shall not be required to report its22
expenditure of funds received pursuant to this Subsection to the Southwest Louisiana23
Convention and Visitors Bureau.24

§4577. Beauregard Parish Covered Arena Authority; creation; jurisdiction;2
purposes; board; powers3

(2) The president of the Beauregard Parish Police Jury shall serve a term6
concurrent with that of his elected office.  The remaining members appointed to7
succeed the initial members shall serve at the pleasure of the respective appointing8
authority.  Such members shall operate and maintain the covered arena facility after9
the facility is substantially complete and shall have the following powers and duties:10
(a) To enter into contracts for the sale, lease, or exchange of property of or11
for the authority.12
(b) To enter into cooperative endeavors with any special district, political13
subdivision, or local governmental unit of the state.14
(c) To accept donations of money or property to accomplish the authority's15
purposes from public or private sources.16
(d) To fix, maintain, collect, and revise rates, charges, and rentals for the use17
of authority facilities and services.18
(e)  To repair, maintain, and operate authority facilities.19
(f) To contract with any public or private entities for the maintenance and20
operation of property owned or operated by the authority.21
(g) To borrow money to pay its obligations and to accomplish the22
authority's purpose.23
(h) To do any and all things necessary to carry out the purposes of the24
authority.25

§4577.1.  Beauregard Parish Covered Arena27
In addition to powers otherwise granted by law, the Beauregard Parish28
governing authority shall have the following powers and duties with respect to29
owning, operating, and maintaining the Beauregard Parish Covered Arena:30 SB NO. 626	ENROLLED

(1)  To enter into contracts for the sale, lease, or exchange of property.1
(2) To enter into cooperative endeavors with any special district,2
political subdivision, or local governmental unit of the state.3
(3) To accept donations of money or property from public or private4
sources.5
(4) To fix, maintain, collect, and revise rates, charges, and rentals for the6
use of facilities and services.7
(5)  To repair, maintain, and operate facilities.8
(6) To contract with any public or private entities for the maintenance9
and operation of the property.10
(7)  To borrow money to pay its obligations.11
(8)  To do any and all things necessary to carry out the purposes of the12
authority.13
Section 2.  R.S. 33:4577 is hereby repealed on July 1, 2013.14
Section 3.(A)(1)  As used in this Section:15
(a) "Arena" means the Beauregard Parish Covered Arena, including all land,16
rights-of-way, servitudes, and improvements situated thereon, or connected17
therewith, for such purpose.18
(b)  "Authority" means the Beauregard Parish Covered Arena Authority.19
(c)  "Police jury" means the Beauregard Parish governing authority.20
(2) In accordance with, and pursuant to, Article VI, Section 14(A) of the21
Constitution of Louisiana, the arena shall transfer from the authority to the police22
jury on or before January 1, 2013. Thereafter, the arena shall be owned, managed,23
maintained, and controlled by the police jury which shall be the successor of the24
authority.25
(B)  This Act is not intended to nor shall it be construed to impair the26
contractual or other obligations of the authority existing on the date the arena is27
transferred to the police jury in accordance with this Act.  Upon the date of the28
transfer of the arena, all obligations of the authority shall be deemed to be29
obligations of the police jury to the same extent as if originally incurred by it.30 SB NO. 626	ENROLLED

(C) Any legal proceeding to which the authority is a party and which is filed,1
initiated, or pending before any court on July 1, 2013, and all documents involved2
in or affected by said legal proceeding, shall retain its effectiveness and shall be3
continued in the name of the police jury. 4
(D) All outstanding indebtedness of the authority shall become the liability5
of the police jury when the arena is transferred to the police jury.6
(E) The proceeds from a tax and other revenue received by the authority may7
be used or expended by the police jury only for a purpose for which the tax is levied8
and revenue is collected.9
(F) All books, records, documents, funds, and movable property of the10
authority shall be transferred to the police jury on or before July 1, 2013.11
Section 4. Except as provided in Section 2 of this Act, this Act shall become12
effective upon signature by the governor or, if not signed by the governor, upon expiration13
of the time for bills to become law without signature by the governor, as provided by Article14
III, Section 18 of the Constitution of Louisiana. If vetoed by the governor and subsequently15
approved by the legislature, this Act shall become effective on the day following such16
approval.17
