SENATE BILL NO. 651
BY SENATOR BROWN 
CORRECTIONAL FACILITIES. To provide relative to transfer and housing of persons
indicted for first degree murder under certain circumstances.  (8/1/12)
AN ACT1
To enact Code of Criminal Procedure Article 500, relative to procedures after indictment;2
to provide that persons indicted for first degree murder under certain circumstances3
are to be housed at the Louisiana State Penitentiary; and to provide for related4
matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. Code of Criminal Procedure Article 500 is hereby enacted to read as7
follows: 8
Art. 500.  Pretrial detention of certain persons9
Notwithstanding any other provision of law to the contrary, a person10
ordered held in custody following indictment for any of the following offenses11
shall be confined at the Louisiana State Penitentiary while awaiting trial or12
other disposition of his case:13
(1) First degree murder, R.S. 14:30, when the offender has a specific14
intent to kill or to inflict great bodily harm upon more than one person.15
(2) First degree murder, R.S. 14:30, when the offender has a specific16
intent to kill or to inflict great bodily harm upon a victim who is under the age17 SB NO. 651

of twelve or sixty-five years of age or older.1
(3) First degree murder, R.S. 14:30, or second degree murder, R.S.2
14:30.1, when the offender has a specific intent to kill or to inflict great bodily3
harm upon a victim who is mentally or developmentally disabled.4
(4) First degree murder, R.S. 14:30, or second degree murder, R.S.5
14:30.1, when the offender has a specific intent to kill or to inflict great bodily6
harm upon a victim who is a minister, priest, rabbi, or other member of the7
clergy.8
(5) First degree murder, R.S. 14:30, or second degree murder, R.S.9
14:30.1, when the offender has a specific intent to kill or to inflict great bodily10
harm upon a victim who is an elected public official.11
(6) Intimidating, impeding, or injuring witnesses, R.S. 14:129.1.12

Proposed law provides that a person ordered held in custody following indictment for any
of the following offenses is to be confined at the Louisiana State Penitentiary while awaiting
trial or other disposition of his case:
1. First degree murder when the offender has a specific intent to kill or to inflict great
bodily harm upon more than one person.
2. First degree murder when the offender has a specific intent to kill or to inflict great
bodily harm upon a victim who is under the age of 12 or 65 years of age or older.
3. First degree murder or second degree murder when the offender has a specific intent
to kill or to inflict great bodily harm upon a victim who is mentally or
developmentally disabled.
4. First degree murder or second degree murder when the offender has a specific intent
to kill or to inflict great bodily harm upon a victim who is a minister, priest, rabbi,
or other member of the clergy.
5. First degree murder or second degree murder when the offender has a specific intent
to kill or to inflict great bodily harm upon a victim who is an elected public official.
6. Intimidating, impeding, or injuring witnesses.
Effective August 1, 2012.
