Requires electronic or telephone verification that persons involved in an accident are in compliance with the Motor Vehicle Safety Responsibility Law. (8/1/12) AN ACT1 To amend and reenact R.S. 32:398(E)(1), relative to accident reports; to require law2 enforcement officers investigating an accident to confirm compliance with the Motor3 Vehicle Safety Responsibility Law electronically or by telephone; and to provide for4 related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 32:398(E)(1) is hereby amended and reenacted to read as follows:7 ยง398. Accident reports; when and to whom made; information aid; fees for copies;8 fees for accident photographs9 * * *10 E.(1) Every law enforcement officer who investigates an accident shall initial11 the accident report form to show that the officer has complied with the provisions of12 Subsection D of this Section, and shall indicate on the accident form whether the13 investigation is made at the scene of the accident or by subsequent investigation and14 interviews. DIGEST Present law requires the state police, sheriffs, or city police to investigate all accidents required to be reported in present law. Further requires every law enforcement officer who investigates an accident to instruct the driver of each vehicle involved in the accident to report the following to all parties suffering injury or property damage as an apparent result of the accident: 1. The name and address of the owner and driver of the vehicle. 2. The license number of the vehicle. 3. The name of the liability carrier for the vehicle; and the name, address, and telephone number of the insurance agent who procured the liability policy providing coverage for the vehicle. Further requires every law enforcement officer who investigates an accident to initial the accident report form to show that the officer has complied with the provisions of present law. Proposed law retains present law and further requires the law enforcement officer to indicate on the accident report form electronic or telephone verification of compliance with the Motor Vehicle Safety Responsibility Law.
