Provides for powers and duties of the Board of Regents with respect to the distribution of funds to postsecondary education institutions. (8/1/12) AN ACT1 To amend and reenact R.S. 17:3128(A) and (B)(2), relative to postsecondary education; to2 provide for the powers and duties of the Board of Regents; to provide relative to the3 distribution of funds to institutions of postsecondary education; and to provide for4 related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 17:3128(A) and (B)(2) are hereby amended and reenacted to read as7 follows: 8 ยง3128. Power to formulate master plan; mission establishment9 A. The Board of Regents shall have the power to formulate and make timely10 revision of a master plan for postsecondary education. As a minimum, the plan shall11 include a formula for equitable distribution of funds to the institutions of12 postsecondary education. Equitable for purposes of the distribution formula13 means equitable as the institutions are compared to their respective Southern14 Regional Education Board peer averages unless an institution fails to meet the15 applicable performance requirements established pursuant to R.S. 17:3139 et16 seq. The formula for equitable7 distribution of funds shall be developed with strong consideration for8 institutional mission as an overriding factor in resource allocation, and no9 institution that is fulfilling its mission shall be penalized in such formula based10 on a comparative evaluation of missions. The management boards in11 conjunction with the Board of Regents shall develop not less than three12 performance allocation models based upon institutional type, mission, students13 served, and alignment with the performance requirements established pursuant14 to R.S. 17:3139 et seq. Specifically, by way of example but not limitation, given15 the open admissions policies of community and technical colleges, such16 institutions shall be funded for all credit enrollments without regard to the17 letter grade earned for the credit by a student. Annually, the board shall review18 and align all institutions to their appropriate Southern Regional Education19 Board classification, including official submittal to the Southern Regional20 Education Board to implement the classification changes. The board shall21 provide an annual report to the legislature and the governor on the status of higher22 education relative to the mission statements, including in such report all revisions23 since the last report and any recommendations for legislative or gubernatorial action.24 * * *25 Section 2.
