SENATE BILL NO. 668

MOTOR VEHICLES.  Limits the prohibition on non-resident exhibitors participating in
recreational product shows. (8/1/12)
AN ACT1
To enact R.S. 32:1256.1, to provide relative to recreational product shows; to provide for2
participation in certain recreational product shows by nonresident exhibitors; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 32:1256.1 is hereby enacted to read as follows: 6
ยง1256.1.  Recreational products shows; nonresident exhibitors7
Notwithstanding the provisions of R.S. 32:1256 and any other law and8
any commission rule to the contrary, in a city or municipality with a population9
less than seventy-two thousand and more than seventy thousand, as determined10
by the most recent federal decennial census, a nonresident exhibitor who is a11
recreational products dealer, distributor, or manufacturer who holds a current12
equivalent license in another state may participate in a recreational products13
show in Louisiana provided all of the following criteria are satisfied:14
(1) Louisiana recreational products dealers whose franchise area for the15
brands they represent includes the location of the show have been given the first16
option on space at the recreational products show.17 SB NO. 668

(2) Non-Louisiana recreational products dealers, distributors, and1
manufacturers shall not show the same brand of recreational product as shown2
by participating Louisiana recreational products dealers.3
(3) Non-Louisiana recreational products dealers, distributors, and4
manufacturers shall register their participation with the commission not later5
than ten business days prior to the date of the show. To register, each non-6
Louisiana recreational products dealer, distributor, and manufacturer shall7
submit to the commission its name, address, and a copy of its current equivalent8
license from the state of its domicile.9

DIGEST
Present law defines "recreational products" as new and unused motorcycles, all-terrain
vehicles, marine products, recreational vehicles, and trailers.
Present law provides that the Motor Vehicle Commission may authorize or prohibit motor
vehicle or recreational products sales and shows at off-site locations and may, in its
discretion, allow such sales and shows in accordance with rules and regulations adopted by
the commission in accordance with the Administrative Procedure Act. The commission has
adopted such rules in Chapter 15, Subpart 1, Part V of Title 46 of the Louisiana
Administrative Code, entitled "Recreational Product Shows", comprised of Sections 1501
through 1515.
Proposed law provides that notwithstanding present law and commission rules, in a city or
municipality with a population less than seventy-two thousand and more than seventy
thousand, as determined by the most recent federal decennial census, may participate in a
recreational products show in Louisiana provided all of the following criteria are satisfied:
1. Louisiana recreational products dealers, whose franchise area for the brands they
represent includes the location of the show, have been given the first option on space
at the recreational products show.
2. Non-Louisiana recreational products dealers, distributors, and manufacturers shall
not show the same brand of recreational product as shown by participating Louisiana
recreational products dealers.
3. Non-Louisiana recreational products dealers, distributors, and manufacturers shall
register their participation with the commission not later than ten business days prior
to the date of the show. To register, each non-Louisiana recreational products dealer,
distributor, and manufacturer shall submit to the commission its name, address, and
a copy of its current equivalent license from the state of its domicile.
Effective August 1, 2012.
