HOUSING. Changes the definition of "persons or families of low or moderate income" for
purposes of the Louisiana Housing Corporation Act. (8/1/12)
AN ACT1
To amend and reenact 40:600.87(8), relative to the definition of "persons or families of low2
or moderate income" for purposes of the Louisiana Housing Corporation Act; to3
change certain definitions; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 40:600.87(8) is hereby amended and reenacted to read as follows:6
ยง600.87.  Definitions7
The following terms, whenever used or referred to in this Chapter shall have8
the following meanings, unless the context clearly indicates otherwise:9

(8) "Persons or families of low or moderate income" means an individual or11
household whose income qualifies as low income or moderate income as defined by12
the United States Department of Housing and Urban Development (HUD) as13
adjusted from time to time. HUD defines low income as any individual or household14
earning less than fifty percent of the area median income.  HUD defines moderate15
income as any individual or household earning between fifty percent and eighty16

benefit or assistance pursuant to the applicable state or federal statutes, rules,1
and regulations governing the administration of the program under which the2
person or family shall receive such benefit or assistance as determined by the3
Louisiana Housing Corporation.4

DIGEST
Present law, for purposes of the Louisiana Housing Corporation Act, defines "persons or
families of low or moderate income" as an individual or household whose income qualifies
as low income or moderate income as defined by the United States Department of Housing
and Urban Development (HUD) as adjusted from time to time.  HUD defines low income
as any individual or household earning less than 50% of the area median income (AMI).
HUD defines moderate income as any individual or household earning between 50% and
80% of the AMI.
Proposed law deletes present law definition and instead defines "persons or families of low
or moderate income" as a person or family who qualifies to receive a benefit or assistance
pursuant to the applicable state or federal statutes, rules, and regulations governing the
administration of the program under which the person or family receives such benefit or
assistance as determined by the Louisiana Housing Corporation.
Effective August 1, 2012.
