PRIVATE SECURITY.  Provides relative to security officers and services. (8/1/12)
AN ACT1
To amend and reenact R.S. 37:3272(A)(18)(h) and 3298(B) and to repeal R.S. 37:3298(D),2
relative to the Private Security Regulatory and Licensing Law; to provide for3
definitions; to provide for exceptions, and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 37:3272(A)(18)(h) and 3298(B) are hereby amended and reenacted6
to read as follows: 7
§3272.  General definition of terms 8
A. As used in this Chapter, the following terms shall have the following9
meanings ascribed to them: 10

(18) "Security officer" means an individual who is principally employed by12
a contract security company whether armed or unarmed, to protect a person or13
persons or property or both, and whose duties include but are not limited to the14
following:15

except on public streets, whether by vehicle, on foot, or otherwise.1

§3298. Inapplicability3

B. This Chapter shall not apply to a peace officer employed by a state, parish,5
or local law enforcement agency who contracts directly with 	an employer the6
consumer of contract security services to work during his off-duty hours and7
whose off-duty employment is conducted on an independent contractor basis with8
an employer such consumer of security services; however, nothing herein shall be9
construed to authorize peace officers to employ non-commissioned peace officers10
to perform any private security functions as defined in this Subsection.11

Section 2.  R.S. 37:3298(D) is hereby repealed.13

DIGEST
Present law provides for the licensure of private security agents and businesses in Louisiana.
Present law provides for definitions.
Proposed law changes the definition of "security officer".
Present law does not apply to a peace officer employed by a state, parish, or local law
enforcement agency who contracts directly with an employer to work during his off-duty
hours and whose off-duty employment is conducted on an independent contractor basis with
an employer.
Proposed law changes the inapplicability of present law from a peace officer or local law
enforcement agency contracting directly with an employer to a peace officer or local law
enforcement agency contracting directly with the consumer of contract security services.
Effective August 1, 2012.
(Amends R.S. 37:3272(A)(18)(h) and 3298(B); repeals R.S. 37:3298(D))
