Requires the "actual value" upon which the annual motor vehicle license tax must be based for each renewal to be the fair market value of the vehicle at the time of renewal. (gov sig) AN ACT1 To amend and reenact R.S. 47:463(A)(2), relative to motor vehicle license tax; to provide2 for the actual value upon which the annual motor vehicle license tax must be based3 for each renewal; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 47:463(A)(2) is hereby amended and reenacted to read as follows:6 ยง463. Private passenger vehicles; amputee veterans exempted; church, church7 school, and religious order vehicles 8 A. * * *9 (2) For purposes of this Subsection, the actual value of each vehicle shall be10 determined as of the time of purchase or first renewal after the effective date of this11 Section according to criteria established by the secretary for the first registration12 of such vehicle, and the actual value upon which the tax shall be based on said13 value for each renewal thereafter shall be the fair market value of the vehicle at14 the time of renewal according to criteria established by the secretary. The2 secretary shall provide by rules and regulations for the implementation of this3 Subsection. Such rules and regulations shall be subject to an oversight review by the4 Joint Legislative Committee on Transportation, Highways and Public Works.5 * * *6 Section 2. The provisions of this Act shall be applicable to renewals occurring on and7 after January 1, 2013.8 Section 3. The rules and regulations implementing the provisions of this Act shall9 be subject to oversight review by the Joint Legislative Committee on Transportation,10 Highways and Public Works prior to September 1, 2012.11 Section 4. This Act shall become effective upon signature by the governor or, if not12 signed by the governor, upon expiration of the time for bills to become law without signature13 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. DIGEST Present constitution requires the legislature to impose an annual license tax of not more than one dollar per each $1,000 of "actual value" on automobiles for private use based on the "actual value" of the vehicle, as provided by law. However, the tax cannot be less than $10 per automobile for private use. Present law specifies that the levy of the annual tax on automobiles having an "actual value" of $10,000 or less is $10.00. For automobiles having an "actual value" of greater than $10,000, the annual license tax is the base tax of $10.00 plus an additional tax of $1.00 per each $1,000 of "actual value" above $10,000. Present law requires "actual value" to be determined at the time of purchase according to criteria established by the secretary for both first-time registration and renewals. Proposed law requires the "actual value" upon which the tax must be based for each renewal to be the fair market value of the vehicle at the time of renewal according to criteria established by the secretary. Proposed law is applicable to renewals occurring on and after January 1, 2013.
