MUNICIPAL EMPLOYEE RET.  Provides for board membership and elections. (7/1/12)
AN ACT1
To amend and reenact R.S. 11:1821(B) and (H)(1) and to enact R.S. 11:1821(C)(3) and (4)2
and (H)(4), relative to the Municipal Employees' Retirement System; to provide for3
the composition of the board of trustees; to provide for an effective date; and to4
provide for related matters.5
Notice of intention to introduce this Act has been published.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 11:1821(B) and (H)(1) are hereby amended and reenacted and R.S.8
11:1821(C)(3) and (4) and (H)(4) are hereby enacted to read as follows: 9
ยง1821. Board of trustees; membership; term of office; oath of office; compensation;10
voting power; vacancies11

B. The board shall consist of nine trustees, six of whom shall be active and13
contributing members of the system with at least ten years of creditable service,14
elected by the members of this system in accordance with the election rules15
prescribed by the board; one of whom shall be the:16

with the election rules prescribed by the board, three of whom shall not be1
elected officials but shall be active contributing members of the system with ten2
or more years of creditable service, and three of whom shall be active3
contributing elected officials, with ten or more years of creditable service,4
provided that no municipality shall have more than two members, whether non-5
elected members or elected officials, on the board at the same time.6
(2) The president of the Louisiana Municipal Association , who shall serve7
as an ex officio, member during his tenure.;8
(3) The one of whom shall be the chairman of the Senate Finance Committee,9
but after April 15, 1980, his place shall be taken by the chairman of the Senate10
Committee on Retirement Committee, ex officio, or his designee., who shall serve11
as a voting ex officio member; and one of whom shall be the12

officio of the Legislature of Louisiana, or his designee, who shall serve as a voting14
ex officio member.15

(3) The successor of the member of the board of trustees whose term18
expires in 2012 and the successor of any member whose term expires in any19
even-numbered year thereafter shall be elected to the board of trustees for a20
term of six years beginning on the first of December in the year of his election.21
A member elected pursuant to this Paragraph shall not be an elected official.22
(4) The successor of the member of the board of trustees whose term23
expires in 2013 and the successor of any member whose term expires in any24
odd-numbered year thereafter shall be elected to the board of trustees for a25
term of six years beginning on the first of June in the year of his election.  A26
member elected pursuant to this Paragraph shall be an elected official.27

election to the board of trustees shall have his name included on the election ballot,1
provided his name is submitted in accordance with the provisions of this Section2
and the rules applicable to all candidates for such election.3

(4) The candidate who receives the highest vote tallies, and who does not5
violate the prohibition against more than two trustees serving from the same6
municipality, shall be declared the elected trustee.7
Section 2. This Act shall become effective on July 1, 2012; if vetoed by the governor8
and subsequently approved by the legislature, this Act shall become effective on July 1,9
2012, or on the day following such approval by the legislature, whichever is later.10

DIGEST
Proposed law relative to the Municipal Employees' Retirement System provides for election
of members of the board of trustees, subject to the limitation that no municipality shall have
more than two members on the board at the same time.
Effective July 1, 2012.
