GAMING. Provides for restriction on application after finding of unsuitability or revocation

AN ACT1
To amend and reenact R.S. 27:28(E) and 308(D), relative to gaming and video poker; to2
provide with respect to the powers and duties of the Gaming Control Board; to3
provide relative to restriction on application after a finding of unsuitability or4
revocation of license, permit or approval; to provide for an effective date; and to5
provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 27:28(E) and 308(D) are hereby amended and reenacted to read as8
follows: 9
§28. Suitability standards10

E. Any person whose license or permit has been revoked or who has been12
found unsuitable in this state or any other jurisdiction is not eligible to obtain any13
license or permit pursuant to the provisions of this Title for a period of five years14
from the date the revocation or finding of unsuitability becomes final. A person who15
has been found unsuitable or whose license, permit or approval has been16
revoked, in this state or any other jurisdiction, may not apply for a license,17 SB NO. 93

permit, or approval or a finding of suitability for five years from the date there1
was a finding of unsuitability, or the license, permit or approval was revoked,2
unless the board allows application for good cause shown.  The board shall3
promulgate rules necessary to carry out the provisions of this Section.4

§308. Powers and duties of the board or division; restrictions; permits6

D. For a period of five years from the date of the revocation of the license,8
no license authorized by this Chapter may be granted to any person whose previous9
license was revoked by the division. A person who has been found unsuitable or10
whose license, permit or approval has been revoked, may not apply for a license,11
permit, or approval or a finding of suitability for five years from the date there12
was a finding of unsuitability, or the license, permit or approval was revoked,13
unless the board allows application for good cause shown.  The board shall14
promulgate rules necessary to carry out the provisions of this Section.15

Section 2. This Act shall become effective upon signature by the governor or, if not17
signed by the governor, upon expiration of the time for bills to become law without signature18
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If19
vetoed by the governor and subsequently approved by the legislature, this Act shall become20
effective on the day following such approval.21

DIGEST
Present law, regarding casino gaming and riverboat gaming provides that any person whose
license or permit has been revoked or who has been found unsuitable in this state or any
other jurisdiction is not eligible to obtain any license or permit pursuant to the provisions of
present law for a period of five years from the date the revocation or finding of unsuitability
becomes final.
Present law, regarding video poker provides that for a period of five years from the date of
the revocation of the license, no license authorized by present law may be granted to any
person whose previous license was revoked by the gaming enforcement division of the office

Proposed law provides that, for purposes of casino gaming, riverboat gaming and video
poker, a person who has been found unsuitable or whose license, permit or approval has been
revoked, may not apply for a license, permit, or approval or a finding of suitability for five
years from the date there was a finding of unsuitability, or the license, permit or approval
was revoked, unless the Gaming Control Board allows application for good cause shown.
Proposed law provides that the board shall promulgate rules necessary to carry out the
provisions of proposed law.
Effective upon signature of the governor or lapse of time for gubernatorial action.
