AN ACT1 To authorize and provide for the transfer of certain state property; to authorize the transfer2 of certain state property in Rapides Parish; to provide for the property descriptions;3 to provide for reservation of mineral rights; to provide terms and conditions; to4 provide an effective date; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. The secretary of the Department of Health and Hospitals, notwithstanding7 any other provision of law to the contrary, is hereby authorized and empowered to convey,8 transfer, assign, lease or deliver any interest, excluding mineral rights, the state may have9 to all or any portion of the following described parcels of property to the city of Pineville:10 A certain piece, parcel or lot of ground, together with all improvements thereon, rights, ways11 and privileges thereunto belonging or in any way appertaining, being, lying and situated in12 the Section 17, Township 4 North, Range 1 West, Rapides Parish, Louisiana, being more13 particularly described as follows, to wit:14 Commencing at a 4” x 4” concrete monument marking the northwest corner of the city of15 Pineville’s Wastewater Treatment Facility tract; thence proceed South 39 degrees 05 minutes16 29 seconds West, grid bearing, along the northwest boundary line of said city of Pineville17 tract, a distance of 371.23 feet to a 5/8” diameter iron rod (set) marking the POINT OF18 BEGINNING of the tract be described;19 thence continue South 39 degrees 05 minutes 29 seconds West, along said northwest20 boundary line, a distance of 693.37 feet to a 3/4” diameter iron rod (found) marking the21 southwest corner of said city of Pineville Wastewater Treatment Facility tract; thence22 continue South 39 degrees 05 minutes 29 seconds West, along an extension of said23 northwest boundary line and crossing the Red River Levee, a distance of 275.82 feet to a24 5/8” diameter iron rod (set); thence turn right and proceed North 38 degrees 30 minutes 4325 seconds West, departing said northwest boundary line extension, a distance of 88.36 feet to26 a pk nail with shiner in asphalt pavement (set); thence turn right and proceed North 1027 degrees 22 minutes 23 seconds West, a distance of 226.13 feet to a 5/8” diameter iron rod28 (set); thence turn right and proceed North 03 degrees 12 minutes 43 seconds East, a distance29 of 911.96 feet to a 5/8” diameter iron rod (set); thence turn right and proceed South 8630 degrees 46 minutes 58 seconds East, a distance of 465.08 feet to a 5/8” diameter iron rod31 (set); thence turn right and proceed South 24 degrees 18 minutes 32 seconds East, a distance32 of 465.00 feet to the POINT OF BEGINNING;33 The above described tract contains 12.299 acres, more or less, and is more particularly34 indicated as Tract 1 on Pan American Engineers - Alexandria, Inc., Drawing No. 12089,35 dated November 2, 2012.36 ENROLLEDHB NO. 16 Page 2 of 3 Section 2. The secretary of the Department of Health and Hospitals is hereby1 authorized to enter into such agreements, covenants, conditions, and stipulations and to2 execute such documents as necessary to properly effectuate any conveyance, transfer,3 assignment, lease or delivery of title, excluding mineral rights, to the property described in4 Section 1 of this Act, and as more specifically described in any such agreements entered into5 and documents executed by and between the secretary of the Department of Health and6 Hospitals and the city of Pineville, in exchange of consideration proportionate to the7 appraised value of the property.8 Section 3. The secretary of the Department of Culture, Recreation and Tourism,9 notwithstanding any other provision of law to the contrary, is hereby authorized and10 empowered to convey, transfer, assign, lease or deliver any interest, excluding mineral11 rights, the state may have to all or any portion of the following described parcel of property12 to the city of Pineville:13 A certain piece, parcel or lot of ground, together with all improvements thereon, rights, ways14 and privileges thereunto belonging or in any way appertaining, being, lying and situated in15 the Section 17, Township 4 North, Range l West, Rapides Parish, Louisiana, being more16 particularly described as follows, to wit:17 Commencing at a 4” x 4" concrete monument marking the northwest corner of the city of18 Pineville’s Wastewater Treatment Facility tract; thence proceed South 39 degrees 05 minutes19 29 seconds West, grid bearing, along the northwest boundary line of said city of Pineville20 tract, a distance of 204.78 feet to a 5/8” diameter iron rod (set) marking the POINT OF21 BEGINNING of the tract be described;22 thence continue South 39 degrees 05 minutes 29 seconds West, along said northwest23 boundary line, a distance of 166.45 feet to a 5/8” diameter iron rod (set); thence turn right24 and proceed North 24 degrees 18 minutes 32 seconds West, departing said northwest25 boundary line, a distance of 133.37 feet to a 5/8” diameter iron rod (set); thence turn right26 and proceed North 87 degrees 15 minutes 46 seconds East, a distance of 160.05 feet to the27 POINT OF BEGINNING;28 The above described tract contains 0.228 acres, more or less, and is more particularly29 indicated as Tract 2 on Pan American Engineers - Alexandria, Inc., Drawing No. 12089,30 dated November 2, 2012.31 Section 4. The secretary of the Department of Culture, Recreation and Tourism is32 hereby authorized to enter into such agreements, covenants, conditions, and stipulations and33 to execute such documents as necessary to properly effectuate any conveyance, transfer,34 assignment, lease or delivery of title, excluding mineral rights, to the properties described35 in Section 3, and as more specifically described in any such agreements entered into and36 documents executed by and between the secretary of the Department of Culture, Recreation37 ENROLLEDHB NO. 16 Page 3 of 3 and Tourism and the city of Pineville, in exchange of consideration proportionate to the1 appraised value of the property.2 Section 5. This Act shall become effective upon signature by the governor or, if not3 signed by the governor, upon expiration of the time for bills to become law without signature4 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
