MOTOR VEHICLES: Prohibits attachments on motor vehicle wheels from extending past a certain width AN ACT1 To amend and reenact R.S. 32:362(B), relative to motor vehicle wheels; to restrict the use2 of certain motor vehicle wheel equipment that extends beyond the body of a motor3 vehicle; to provide for definitions; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 32:362(B) is hereby amended and reenacted to read as follows: 6 ยง362. Restrictions as to tire and wheel equipment7 * * *8 B.(1) No tire on a vehicle moved on a highway shall have on its periphery9 any protuberances of any material, other than rubber, which projects beyond the10 thread of the traction surface of the tire., except that it shall be permissible to:11 (2) No vehicle shall be equipped with wheel nuts, hubcaps, or wheel discs12 extending outside the body of the vehicle when viewed from directly above which:13 (a) Incorporate winged projections; or14 (b) Constitute a hazard to pedestrians or cyclists.15 (3)(a) Paragraph (2) of this Subsection shall not apply to vehicles with a16 gross vehicle weight greater than nine thousand nine hundred pounds or to wheel17 nuts, hubcaps, or wheel discs that are designed, licensed, or produced by the18 manufacturer of the vehicle to which they are attached.19 HLS 13RS-500 REENGROSSED HB NO. 170 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (b) For purposes of Paragraphs (2) and (3) of this Subsection, a "wheel nut"1 shall mean an exposed nut which is mounted at the center or hub of a wheel and is2 not one of the ordinary hexagonal nuts which secure a wheel to an axle and is3 normally covered by a hubcap or wheel disc.4 (4) Notwithstanding Paragraphs (1) and (2) of this Subsection, it shall be5 permissible to:6 (a) Use farm machinery with tires having protuberances which will not injure7 the highways ; and.8 (b) Use tire chains of reasonable proportions upon any vehicle, when9 required for safety because of conditions tending to cause a vehicle to slide or skid.10 * * *11 DIGEST The digest printed below was prepared by House Legislative Services. Present law provides that no tire on a vehicle moved on a highway shall have on its periphery any protuberances of any material, other than rubber, which projects beyond the thread of the traction surface of the tire and provides for exceptions for certain farm machinery and tire chains. Proposed law retains present law and additionally provides that no vehicle shall be equipped with certain wheel equipment that extends outside the body of a vehicle when viewed from directly above which incorporate winged projections or constitute a hazard to pedestrians and cyclists. Proposed law shall not apply to vehicles with a gross vehicle weight greater than 9,900 pounds or wheel nuts, hubcaps, or wheel discs that are designed, licensed, or produced by the manufacturer of the vehicle to which they are attached.
