PUBLIC CONTRACT/BIDS: Allows public entities in Evangeline Parish to let a contract
to other than the lowest bidder in certain circumstances
AN ACT1
To enact R.S. 38:2214.1, relative to public contracts; to authorize public entities in2
Evangeline Parish to let a contract to other than the lowest bidder under certain3
circumstances; and to provide for related matters.4
Notice of intention to introduce this Act has been published5
as provided by Article III, Section 13 of the Constitution of6
Louisiana.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 38:2214.1 is hereby enacted to read as follows:9
ยง2214.1. Right to modify bids10
A. A public entity letting public contracts in Evangeline Parish, including but11
not limited to contracts for waste management services, may accept the bid and12
contract with a local resident contractor, if the bid is not the lowest bid received,13
provided that all of the following conditions are met:14
(1) The lowest bid is not offered by a local resident contractor.15
(2) The bid offered by the local resident contractor does not exceed the16
lowest bid received by more than five percent.17
(3) The local resident contractor agrees to provide services or fulfill the18
contract at the same price as the lowest bid received.19 HLS 13RS-37 ORIGINAL

B. For purposes of this Section "local resident contractor" shall mean a1
contractor whose business headquarters is domiciled and located in Evangeline2
Parish.3

Abstract: Authorizes public entities in Evangeline Parish to accept the bid of a local
resident contractor, if the bid is not the lowest bid offered in certain situations.
Proposed law authorizes a public entity of Evangeline Parish to accept the bid of the local
resident contractor of Evangeline Parish, if the bid is not the lowest bid offered, provided
that all of the following conditions are met:
(1)The lowest bid is not offered by a local resident contractor.
(2)The bid offered by the local resident contractor of Evangeline Parish does not exceed
the lowest bid by more than 5%.
(3)The local resident contractor of Evangeline Parish agrees to provide the services or
fulfill the contract at the same price as the lowest bid made.
Proposed law defines "local resident contractor" as a contractor whose business headquarters
are domiciled and located in Evangeline Parish.
