APPROPRIATIONS/JUDGMENT: Appropriates funds for payment of judgment in the
matter of "Jessica L. Varnell and Eric W. Varnell, individually and on behalf of their
minor child, Cassidy Varnell, and Eric W. Varnell, as Administrator of the Estate of
Joseph Delaine Cousson"
AN ACT1
To appropriate funds out of the General Fund of the state of Louisiana for Fiscal Year 2013-2
2014 to be used to pay the consent judgment in the suit entitled "Jessica L. Varnell3
and Eric W. Varnell, individually and on behalf of their minor child, Cassidy4
Varnell, and Eric W. Varnell, as Administrator of the Estate of Joseph Delaine5
Cousson v. State of Louisiana, Department of Transportation and Development"; and6
to provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. The sum of Eight Hundred Thousand and No/100 ($800,000.00) Dollars9
is hereby appropriated out of the General Fund of the state of Louisiana for Fiscal Year10
2013-2014 to be apportioned and paid as follows: Four Hundred Forty Thousand and11
No/100 ($440,000.00) Dollars to Jessica L. Varnell and Eric W. Varnell, on behalf of their12
minor child, Cassidy Varnell and their attorneys, Louis V. Champagne and Michael J.13
Mestayer, APLC, One Hundred Eighty Thousand and No/100 ($180,000.00) Dollars to14
Jessica L. Varnell, individually, and her attorneys, Louis V. Champagne and Michael J.15
Mestayer, APLC, and One Hundred Eighty Thousand and No/100 ($180,000.00) Dollars to16
Eric W. Varnell, individually, and his attorneys, Louis V. Champagne and Michael J.17
Mestayer, APLC, to be used to pay the consent judgment in the suit entitled "Jessica L.18
Varnell and Eric W. Varnell, individually and on behalf of their minor child, Cassidy19

State of Louisiana, Department of Transportation and Development", bearing Number C-1
25957 on the docket of the Thirty-Seventh Judicial District Court, parish of Caldwell, state2
of Louisiana.3
Section 2. The sum of One Hundred Two Thousand Nine Hundred Forty-Five and4
52/100 ($102,945.52) Dollars is hereby appropriated out of the General Fund of the state of5
Louisiana for Fiscal Year 2013-2014 to be paid to the Department of Health and Hospitals6
for medicaid reimbursement in the suit entitled "Jessica L. Varnell and Eric W. Varnell,7
individually and on behalf of their minor child, Cassidy Varnell, and Eric W. Varnell, as8
Administrator of the Estate of Joseph Delaine Cousson v. State of Louisiana, Department9
of Transportation and Development", bearing Number C-25957 on the docket of the Thirty-10
Seventh Judicial District Court, parish of Caldwell, state of Louisiana.11
Section 3. This Act shall become effective on July 1, 2013; if vetoed by the governor12
and subsequently approved by the legislature, this Act shall become effective on July 1,13
2013, or on the day following such approval by the legislature, whichever is later. 14
