HOUSE BILL NO. 460

VITAL STATS/BIRTH CERT:  Provides with respect to birth certificates
AN ACT1
To enact R.S. 9:407, relative to birth certificates; to provide with respect to the signature on2
a birth certificate; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1.  R.S. 9:407 is hereby enacted to read as follows: 5
ยง407.  Contesting signature on birth certificate6
An alleged father who has signed the birth certificate of a child may contest7
the validity of his signature upon proof, by clear and convincing evidence, that his8
signature on the birth certificate was induced by fraud, duress, material mistake of9
fact or error, or that he is not the biological parent of the child.10

Abstract: Authorizes an alleged father to contest his signature on a birth certificate in
certain circumstances.
Proposed law allows an alleged father who has signed a birth certificate to challenge the
validity of his signature upon a showing that the signature was induced by fraud, duress,
material mistake of fact or error, or that he is not the biological parent of the child.
