PUBLIC CONTRACTS: Provides relative to plans for public works projects and above
ground power lines
AN ACT1
To enact R.S. 38:2223(A)(4), relative to public works projects and overhead power lines; to2
require a public entity to provide certain information pertaining to overhead power3
lines on plans for any public works project; to provide relative to liability for4
damages in the event that such information is not provided; and to provide for related5
matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 38:2223(A)(4) is hereby enacted to read as follows:8
ยง2223. Issuance of work orders and commencement of work; underground utilities;9
overhead power lines10

(4) On the plans for any public works project, the public entity or design13
professional of record shall locate and illustrate all overhead power lines and wattage14
thereof and identify the owner of each and all such lines. If the public entity or15
design professional of record fails to locate and illustrate all overhead power lines16
and indicate the wattage and owner of each and all such lines, the contractor shall be17
released from any liability in connection with their damage unless such damage is18
caused by the negligence of the contractor.19

Abstract: Requires all overhead power lines, their wattage, and owner to be illustrated or
identified on plans for public works projects. Provides that a contractor shall not be
liable to any damage caused should this not be done unless that damage was caused
by the gross negligence of the contractor.
Proposed law requires the public entity or design professional on the plans for any public
works project, to locate and illustrate all overhead power lines and indicate the wattage and
identify the owner of each and all such lines.
Proposed law provides that if the public entity or design professional of record fails to locate
and illustrate all overhead power lines and indicate the wattage thereof and identify the
owner of each and all such lines. Specifies that the contractor shall be released from any
liability in connection with their damage unless such damage is caused by the negligence of
the contractor.
