BY REPRESENTATIVES FOIL, ADAMS, BARRAS, BERTHELOT, BROADWATER,
BROSSETT, CARMODY, CHANEY, GAINES, GUI NN, HARRISON,
HOFFMANN, HONORE, TERRY LANDRY, PYLANT, REYNOLDS,
SCHEXNAYDER, AND SEABAUGH
STUDENT/TUITION: Authorizes each public postsecondary education management board
to impose additional tuition and fees for certain programs and purposes
AN ACT1
To enact R.S. 17:3351.11(E) and 3351.17 through 3351.19, relative to tuition and mandatory2
fee amounts for public postsecondary education institutions; to authorize each public3
postsecondary management board to impose certain tuition and fee amounts at4
certain institutions; to provide for effectiveness; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 17:3351.11(E) and 3351.17 through 3351.19 are hereby enacted to7
read as follows:8
§3351.11. Board of Supervisors of Louisiana State University and Agricultural and9
Mechanical College; tuition and attendance fee amounts; Health Sciences10
Centers; waivers11

E. In addition to the authority granted by this Section and any other13
provision of law, including but not limited to R.S. 17:3139.5, and in accordance with14
the provisions of Article VII, Section 2.1(A) of the Constitution of Louisiana, the15
Board of Supervisors of Louisiana State University and Agricultural and Mechanical16
College may impose the following fees for students enrolled in Louisiana State17 HLS 13RS-1169	REENGROSSED

University Health Sciences Center-New Orleans School of Dentistry for the 2013-1
2014 academic year and thereafter:2
(1) A dental supply fee of three hundred dollars per academic year for3
students in the doctor of dental surgery program, the dental hygiene program, and the4
dental laboratory technology program.5
(2) A prosthetic device fee of two hundred seventy-five dollars per academic6
year for second-year students in the doctor of dental surgery program.7

§3351.17. Distance education; tuition and attendance fees; waivers; public9
postsecondary education management boards10
A. In addition to the authority granted by any other provision of law,11
including but not limited to R.S. 17:3139.5, and in accordance with Article VII,12
Section 2.1 of the Constitution of Louisiana, the Board of Supervisors of Louisiana13
State University and Agricultural and Mechanical College, the Board of Supervisors14
of Southern University and Agricultural and Mechanical College, the Board of15
Supervisors for the University of Louisiana System, and the Board of Supervisors16
of Community and Technical Colleges may impose at each institution under its17
respective management and supervision for the Fall 2013 semester and thereafter18
tuition and attendance fees for students enrolled in an academic degree program19
offered entirely through distance education as defined by the Southern Association20
of Colleges and Schools when such program is comparable to a program offered21
through traditional in-person classroom instruction.22
B. The authority granted in Subsection A of this Section shall include the23
authority to impose proportional amounts for part-time students and for summer24
sessions.25
C. Each board shall establish criteria for waiving the tuition and fees26
authorized in Subsection A of this Section in cases of financial hardship as27
determined by the board.  Information relative to such waivers and the criteria and28

in a timely manner such that each student is informed of the availability of a waiver1
prior to the student making a final decision concerning attendance.2
§3351.18. Board of Supervisors of Louisiana State University and Agricultural and3
Mechanical College; digital media program fee; amount; waivers4
A. In addition to the authority granted by any other provision of law,5
including but not limited to R.S. 17:3139.5, and in accordance with Article VII,6
Section 2.1 of the Constitution of Louisiana, the Board of Supervisors of Louisiana7
State University and Agricultural and Mechanical College may impose at Louisiana8
State University and Agricultural and Mechanical College at Baton Rouge for the9
Fall 2013 semester and thereafter a digital media program fee for students enrolled10
in graduate and professional degree programs in digital media in an amount not to11
exceed two thousand five hundred dollars per semester.12
B. The authority granted in Subsection A of this Section shall include the13
authority to impose proportional amounts for part-time students and for summer14
sessions.15
C. The board shall establish criteria for waiving the fee authorized in16
Subsection A of this Section in cases of financial hardship as determined by the17
board. Information relative to such waivers and the criteria and procedures for18
obtaining a waiver shall be made available to all prospective students in a timely19
manner such that each student is informed of the availability of a waiver prior to the20
student making a final decision concerning attendance.21
§3351.19. Building use fee; amount; waivers; public postsecondary education22
management boards23
A. In addition to the authority granted by any other provision of law,24
including but not limited to R.S. 17:3139.5, and in accordance with Article VII,25
Section 2.1 of the Constitution of Louisiana, the Board of Supervisors of Louisiana26
State University and Agricultural and Mechanical College, the Board of Supervisors27
of Southern University and Agricultural and Mechanical College, the Board of28
Supervisors for the University of Louisiana System, and the Board of Supervisors29 HLS 13RS-1169	REENGROSSED

of Community and Technical Colleges may impose at each institution under its1
respective management and supervision, for the Fall 2013 semester and thereafter,2
a building use fee. The amount of the fee shall not exceed forty-eight dollars per3
semester or any higher fee amount otherwise specifically authorized by law,4
notwithstanding Act No. 15 of the 1967 Regular Session of the Legislature of5
Louisiana or any other provision of law to the contrary.6
B. The proceeds of the fee shall be used to construct, acquire, repair,7
maintain, operate, or improve the facilities and physical infrastructure of the8
institution collecting the fee.9
C. The authority granted in Subsection A of this Section shall include the10
authority to impose proportional amounts for part-time students and for summer11
sessions.12
D. Each board shall establish criteria for waiving the fee authorized in13
Subsection A of this Section in cases of financial hardship as determined by the14
board. Information relative to such waivers and the criteria and procedures for15
obtaining a waiver shall be made available to all prospective students in a timely16
manner such that each student is informed of the availability of a waiver prior to the17
student making a final decision concerning attendance.18
Section 2. This Act shall become effective upon signature by the governor or, if not19
signed by the governor, upon expiration of the time for bills to become law without signature20
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If21
vetoed by the governor and subsequently approved by the legislature, this Act shall become22
effective on the day following such approval.23

authorizes the LSU Bd. of Supervisors to impose certain fees for the dental school
in New Orleans and for graduate digital media programs at LSU-Baton Rouge.
Proposed law authorizes each public postsecondary management board to impose the
following:
(1) Tuition and attendance fees for students in an academic degree program offered
entirely through distance education, as defined by the Southern Association of
Colleges and Schools (SACS), when such program is comparable to a program
offered through traditional in-person classroom instruction.
(2)A building use fee in an amount not to exceed $48 per semester or any higher fee
amount otherwise specifically authorized by 	present law.
Proposed law authorizes the LSU Board of Supervisors to impose the following:
At LSU-Baton Rouge:
A digital media program fee for students in graduate and professional degree programs in
digital media in an amount not to exceed $2,500 per semester.
At LSU Health Sciences Center-New Orleans School of Dentistry:
(1) For 2013-2014 and thereafter, a dental supply fee of $300 per academic year for
students in the doctor of dental surgery program, the dental hygiene program, and the
dental laboratory technology program.
(2) For 2013-2014 and thereafter, a prosthetic device fee of $275 per academic year for
second-year students in the doctor of dental surgery program.
(3)Retains present law requirement that the board establish criteria for hardship waivers
and make information about them available to prospective students.
Proposed law, applicable to all of the above proposed law:
(1)Effective for the Fall 2013 semester and thereafter except as otherwise indicated.
(2)Each board may impose proportional amounts for part-time students and for summer
sessions.
(3)Each board shall establish criteria for hardship waivers and make information about
them available to prospective students.
(4) Provides that authority granted by all 	proposed law is in addition to any authority
granted by present law, including the GRAD Act.
(5)Provides that it is in accordance with present constitution, which provides that any
new fee imposed or assessed by a state board or agency must be enacted by law by
a 2/3 vote of the elected members of each house of the legislature.
Effective upon signature of governor or lapse of time for gubernatorial action.
