Regular Session, 2013 SENATE BILL NO. 123 BY SENATOR WHITE AIRCRAFT/AVIATION. Provides with respect to the Greater Baton Rouge Airport District. (8/1/13) AN ACT1 To enact R.S. 2:332 and to repeal Act No. 151 of the 1969 Regular Session of the2 Legislature, Act No. 61 of the 1971 Regular Session of the Legislature, Act No. 8043 of the 1982 Regular Session of the Legislature, Act No. 551 of the 1984 Regular4 Session of the Legislature, and Act No. 91 of the 1995 Regular Session of the5 Legislature, relative to the Greater Baton Rouge Airport District; to provide for the6 creation of an airport district in the parish of East Baton Rouge; to provide for such7 airport district's name and governance, including but not limited to the composition8 and tenure of its board of commissioners, officers, domicile, and authority, including9 amending boundaries, acquiring property, issuing bonds, and taxation; to provide for10 effective dates; and to provide for related matters.11 Notice of intention to introduce this Act has been published.12 Be it enacted by the Legislature of Louisiana:13 Section 1. R.S. 2:332 is hereby enacted to read as follows:14 ยง332. The airport district shall be a political subdivision of the state3 within the meaning of Article VI, Sections 30 through 33 of the Constitution of4 Louisiana and those provisions of the Louisiana Revised Statutes of 19505 applicable to airport districts and the levy of taxes, the incurring of debt, and6 the issuing of bonds by those districts. The governance of the airport district,7 including but not limited to the composition and tenure of a board of8 commissioners, the district's officers, domicile, and authority, including9 authority to amend the district's territorial boundaries, acquire property, issue10 bonds, and levy taxes or fees, shall be as provided by the provisions of this11 Subpart except for the provisions of R.S. 2:313 through 318. The council shall12 provide for the appointment of a board of commissioners for the district as13 provided for in R.S. 2:319 not later than September 1, 2013; however, the14 appointment of a board of commissioners shall not relieve the Metropolitan15 Council of any liability with respect to any outstanding obligation incurred for16 airport purposes prior to the appointment of the board of commissioners,17 including the issuance of bonds, incurred by the airport district prior to18 September 1, 2013.19 Section 2. Act No. 151 of the 1969 Regular Session of the Legislature, Act No. 6120 of the 1971 Regular Session of the Legislature, Act No. 804 of the 1982 Regular Session of21 the Legislature, Act No. 551 of the 1984 Regular Session of the Legislature, and Act No. 9122 of the 1995 Regular Session of the Legislature are hereby repealed in their entirety.23 Section 3. Section 1 and this Section of this Act shall become effective August 1,24 2013. DIGEST Proposed law authorizes the Metropolitan Council of the Parish of East Baton Rouge and the City of Baton Rouge to create an airport district encompassing the parish of East Baton Rouge by resolution of the council at a properly noticed meeting and requires the name of such district be the "Greater Baton Rouge Airport District". Proposed law provides that such airport district is a political subdivision of the state pursuant to Article VI, Sections 30 through 33 of the Constitution of Louisiana and sections of the Louisiana Revised Statutes of 1950, relating to the levy of taxes, the incurring of debt, and the issuing of bonds. Proposed law provides that the governance of the airport district, including but not limited to the composition and tenure of the board of commissioners of the district, its officers, domicile, and authority, including amending boundaries, acquiring property, issuing bonds, and taxation, shall be as provided by the provisions of present law, except for R.S. 2:313 through 318. Proposed law requires the council to act pursuant to R.S. 2:319 which provides that either the council (1) will serve as the governing body of the airport district or (2) will establish and select a board of commissioners composed of either five or seven members at the council's option as the governing body of such airport district not later than September 1, 2013. Proposed law further provides that if the council selects a board of commissioners, this does not relieve the council of any liability with respect to any outstanding obligations incurred for airport purposes prior to such selection, including the issuance of bonds, incurred by the airport district prior to September 1, 2013. Proposed law repeals provisions of prior enactments relative to the Greater Baton Rouge Airport District but only if the council adopts an ordinance creating the Greater Baton Rouge Airport District as provided in proposed law. Effective August 1, 2013.
