AN ACT1
To enact R.S. 39:100.22 and to repeal Section 4 of Act 597 of the 2012 Regular Session,2
relative to special treasury funds; to establish the Balanced Budget Support Fund as3
a special fund in the state treasury; to provide for the transfer, dedication, use,4
investment, and appropriation of the certain funds in the state treasury; to provide for5
an effective date; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 39:100.22 is hereby enacted to read as follows: 8
ยง100.22.  Balanced Budget Support Fund9
The Balanced Budget Support Fund, hereinafter referred to as the10
"fund", is hereby created in the state treasury. The source of monies deposited11
into the fund shall be any monies appropriated by the legislature including12
donations, gifts, grants, or any other monies as may be provided by law. Monies13
in the fund shall be used or expended as provided by law.  Monies in the fund14
shall be invested in the same manner as monies in the state general fund.15
Interest earned on the investment of monies in the fund shall be deposited in16
and credited to the state general fund. Any unexpended and unencumbered17 SB NO. 226

monies in the fund at the end of the fiscal year shall remain in the fund.1
Section 2. The state treasurer is hereby authorized and directed to transfer Eighty-2
Seven Million Three Hundred Twenty Thousand Eight Hundred Seven Dollars from the3
State General Fund (Direct) to the Coastal Protection and Restoration Fund to be comprised4
wholly of nonrecurring revenues recognized from prior year end surpluses.5
Section 3. Notwithstanding any provision of law to the contrary, the state treasurer6
is hereby authorized and directed to transfer Eighty-Seven Million Three Hundred Twenty7
Thousand Eight Hundred Seven Dollars from recurring revenues in the Coastal Protection8
and Restoration Fund into the State General Fund.9
Section 4.  Section 4 of Act 597 of the 2012 Regular Session is hereby repealed.10
Section 5. This Act shall become effective upon signature by the governor or, if not11
signed by the governor, upon expiration of the time for bills to become law without signature12
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If13
vetoed by the governor and subsequently approved by the legislature, this Act shall become14
effective on the day following such approval.15
