AN ACT1
To enact R.S. 13:1381.7, relative to courts and judicial procedure; to provide relative to the2
Orleans Parish Criminal District Court; to provide relative to the office of the clerk3
of court; to provide relative to funding; to provide an effective date; and to provide4
for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 13:1381.7 is hereby enacted to read as follows:7
ยง1381.7.  Clerk of the Orleans Parish Criminal District Court8
A. The legislature finds that adequate funding of the office of Clerk of9
the Criminal District Court for the parish of Orleans is necessary for the10
efficient performance of the powers and duties required of a judicial officer of11
the state. Pursuant to the exercise of the police power of the state, actions for12
obtaining adequate funding are necessary to promote judicial efficiency and to13
protect and promote the lives, health, morals, comfort, and general welfare of14
people as a whole. The amounts to be appropriated and paid by the city of New15
Orleans for expenses, including salaries and maintenance of constitutional16
officers, their deputies, subordinates, and employees shall not be reduced by the17
city of New Orleans without the consent of the legislature. 18
 B. The legislature further finds that state statutes mandating payment19
by the city of New Orleans to the state's employees and officers of the Clerk for20
the Criminal District Court for the parish of Orleans constitute a valid exercise21
of state's police power, and such statutes do not violate the provisions of the22
Louisiana Constitution of 1921 or the Louisiana Constitution of 1974.23

C. Nothing contained in this Act shall be construed as giving to the city1
of New Orleans any rights, powers, authority, or jurisdiction over any2
constitutional officers, their deputies, employees, subordinates, or over any state3
or district officers, their deputies, subordinates, or employees.4
Section 2.  The provisions of this Act shall become effective on July 1, 2013.5
