Page 1 of 2 Regular Session, 2013 ENROLLED SENATE RESOLUTION NO. 39 BY SENATOR GALLOT A RESOLUTION To urge and request the Senate Committee on Local and Municipal Affairs to study the laws applicable to local public entities in the purchase of vehicles for law enforcement purposes. WHEREAS, local public entities that utilize police vehicle patrols generally have a proportionally lower crime rate than communities that do not use such a process; and WHEREAS, it is very important that law enforcement officers have vehicles with peak performance, cutting edge safety features, impressive cargo capacity and efficient ownership cost; and WHEREAS, competitive bidding is a widely used procurement method; and WHEREAS, with competitive bidding the customer can wait a long period of time for products or services that may be required quickly; and WHEREAS, R.S. 38:2212.1(A)(2)(a) allows a local governmental unit to purchase a used or new motor vehicle for conversion into a law enforcement vehicle without the purchase being let for bid as long as the purchase does not exceed twenty thousand dollars; and WHEREAS, laws such as R.S. 38:2212.1(A)(2)(a) should be studied to determine whether the state should revise such statute so the threshold amount be more reflective of data found in the United States Bureau of Labor Statistic's Consumer Price Index for similarly-situated purchases. THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana does hereby urge and request the Senate Committee on Local and Municipal Affairs to study the laws applicable to local public entities in the purchase of vehicles for law enforcement purposes.
