WEAPONS/FIREARMS:  Provides relative to the exemption for law enforcement officers
regarding the carrying of weapons in alcoholic beverage outlets
AN ACT1
To amend and reenact R.S. 14:95.5(C), relative to the possession of a firearm on the2
premises of an alcoholic beverage outlet; to exempt law enforcement officers from3
this prohibition; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 14:95.5(C) is hereby amended and reenacted to read as follows: 6
ยง95.5.  Possession of firearm on premises of alcoholic beverage outlet7

C. The provisions of this Section shall not apply to the owner or lessee of an9
alcoholic beverage outlet, or to an employee of such owner or lessee, or to a law10
enforcement officer or other person vested with law enforcement authority acting in11
the performance of his official duties.  12

Abstract: Provides an exception to the prohibition against carrying firearms in an alcoholic
beverage outlet for law enforcement officers even though they are not acting in the

Present law prohibits any person from possessing a firearm while on the premises of an
alcoholic beverage outlet and provides for criminal penalties including a maximum fine of
$500, a term of imprisonment for not more than six months, or both.
Present law contains exceptions for the owner or lessee of the establishment, an employee
of the owner or lessee, or a law enforcement officer acting in the performance of his official
duties.
Proposed law retains present law except it removes the condition that the law enforcement
officer is acting in the performance of his official duties.
