Abstract: Repeals the private residence exception for the application of enhanced penalties for
controlled dangerous substances violations which occur in drug free zones.
Present law provides for enhanced penalties for violations of the Uniform Controlled Dangerous
Substances Law when the violation occurs on any property used for school purposes by any
school or within 2,000 feet of any such property.
Present law provides for the same enhanced penalties for violations which occur on property
which is a drug treatment facility, religious building property, public housing authority property,
child day care center property, or within 2,000 feet of any such property, if the area is posted as a
drug free zone.
Proposed law retains present law.
Present law further provides for an exception for violations which occur within 2,000 feet of
school property, a drug treatment facility, religious building property, public housing authority
property, or child day care facility property if the violation occurs entirely within a private
residence wherein no person 17 years of age or under was present.
Proposed law repeals this present law exception.
