Regular Session, 2014 HOUSE BILL NO. 1070 BY REPRESENTATIVE BROSSETT PUBLIC CONTRACT/BID S: Provides relative to contracts for public works in certain parishes AN ACT1 To enact R.S. 38:2225.1(B)(3), relative to public work contracts let by certain parish2 governing authorities; to provide for hiring preferences; to provide for an effective3 date; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 38:2225.1(B)(3) is hereby enacted to read as follows:6 ยง2225.1. Contracts in which the state or political subdivision are participants;7 preferences; assistance; exclusions8 * * *9 B.10 * * *11 (3) In addition, upon a finding that there is substantial need to counteract12 grave economic and social ills, the governing authority of a parish with a population13 of not less than three hundred thousand and not more than four hundred thousand14 persons, according to the most recent federal decennial census, may require, as a15 condition of a contract for public works which is to be paid for solely with parish16 funds, that not less than fifty percent of the persons employed in fulfilling that17 contract be residents of the parish granting the contract. This Act shall become effective upon signature by the governor or, if not4 signed by the governor, upon expiration of the time for bills to become law without signature5 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Present law establishes a local hiring preference for certain state agencies, political subdivisions, or parish governing authorities in public work contracts. Proposed law authorizes the governing authority of parishes with populations of at least 300,000 but not more than 400,000 persons, upon a finding that there is substantial need to counteract grave economic and social ills, to require, as a condition of letting contracts for public works to be paid for solely with parish funds, that not less than 50% of the persons employed in fulfilling that contract be residents of the parish granting the contract. Proposed law excludes from this requirement management personnel and persons whose skills are unavailable from performing the work.
