ELECTED OFFICIALS:  Prohibits use of public funds for certain advertisements
AN ACT1
To amend and reenact R.S. 43:111.1, relative to advertisements paid for with public funds;2
to prohibit certain of such advertisements; to provide for exceptions; to provide for3
definitions; to provide for applicability; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 43:111.1 is hereby amended and reenacted to read as follows: 6
ยง111.1.  Advertisements paid for with public funds, restrictions 7
A. No public funds shall be used in whole or in part for the payment of the8
cost of any advertisement containing therein the name or picture of any public9
official whether elected or appointed; provided, however, that the provisions of this10
section Section shall in no case be construed to apply to advertisements or notices11
required or authorized by law to be published or to any advertisements placed by any12
public agency or body authorized by law to advertise in the furtherance of its13
functions and duties.14
B.(1)(a) Notwithstanding the provisions of Subsection A of this Section, no15
public funds shall be used in whole or in part for the payment of the cost of any16
advertisement containing therein the name or picture of a public official, whether17
elected or appointed, within one year prior to a regularly scheduled election for an18

(b) As used in this Paragraph, the term "candidate" shall mean a person who1
seeks nomination or election to public office.2
(2) The provisions of Paragraph (1) of this Subsection shall not apply to an3
advertisement relating to the health, safety, or welfare of Louisiana residents.4

Present law (R.S. 43:111.1) provides that no public funds shall be used in whole or in part
for the payment of the cost of any advertisement containing therein the name of any public
official whether elected or appointed.
Proposed law retains present law and adds an advertisement containing the picture of a
public official to the prohibition.
Present law provides that it shall not be construed to apply to advertisements or notices
required or authorized by law to be published or to advertisements placed by a public agency
or body authorized by law to advertise in the furtherance of its functions and duties.
Proposed law retains present law.
Proposed law additionally provides that no public funds shall be used in whole or in part for
the payment of the cost of any advertisement containing therein the name or picture of any
public official, whether elected or appointed, within one year prior to a regularly scheduled
election for an office for which the public official is a candidate. Provides that the term
"candidate" means a person who seeks nomination or election to public office. Provides an
exception for an advertisement relating to the health, safety, or welfare of La. residents.
