Regular Session, 2014 HOUSE BILL NO. 135 BY REPRESENTATIVE BROSSETT SUPPLEMENTAL PAY: Increases state supplemental pay for firefighters and certain law enforcement officers AN ACT1 To amend and reenact R.S. 33:2002(A)(1) and (4)(a), 2218.2(A)(1) and (2)(a), 2218.8(B)2 and (G), and 2218.10, relative to supplemental pay for firemen, police officers, law3 enforcement officers of certain state agencies and political subdivisions, deputy4 sheriffs, and full-time deputy sheriffs employed as field representatives or process5 servers, harbor police, bridge police, fireboat employees, and certain tribal officers6 and firemen; to increase such supplemental pay; to provide for extra compensation7 for certain commissioned law enforcement officers of certain state agencies, to8 provide for extra compensation for certain harbor police officers, fireboat operators,9 certain tribal officers, and bridge police officers employed by the state; to provide10 for extra compensation for certain tribal firemen; to provide for effectiveness; and11 to provide for related matters.12 Be it enacted by the Legislature of Louisiana:13 Section 1. R.S. 33:2002(A)(1) and (4)(a), 2218.2(A)(1) and (2)(a), 2218.8(B) and14 (G), and 2218.10 are hereby amended and reenacted to read as follows:15 §2002. Extra compensation16 A.(1) In addition to the compensation now paid by any municipality, parish,17 fire protection district, or other political subdivision maintaining a fire department,18 or by the Chitimacha Tribe of Louisiana or the Coushatta Tribe of Louisiana,19 hereinafter referred to as "tribe", or by any nonprofit corporation contracting with20 HLS 14RS-716 ORIGINAL HB NO. 135 Page 2 of 6 CODING: Words in struck through type are deletions from existing law; words underscored are additions. any such political subdivision to provide fire protection services to every paid,1 regularly employed employee who is paid not less than three hundred dollars per2 month, not including supplemental pay, as distinguished from part-time employees3 and volunteers of such fire department, who are carried on the payroll of such fire4 department, and every employee as defined herein who is paid from funds of the5 parish or municipality or tribe obtained through lawfully adopted bond issues,6 lawfully assessed taxes, or other funds available for such purpose, either directly or7 through a board or commission set up by law or ordinance of the parish or8 municipality or tribe, shall be paid extra compensation by the state in the amount of9 five six hundred dollars per month for each such paid employee who has completed10 or who hereafter completes one year of service. The provisions of Paragraph (5) of11 this Subsection shall govern the requirements for length of service for employees12 who were ordered to active miliary duty in the armed services of the United States13 during their initial term of employment.14 * * *15 (4)(a) Every fire protection officer who is employed on a full-time basis by16 a port authority headquartered in the city of New Orleans shall be paid by the state17 extra compensation in the amount of five six hundred dollars per month in addition18 to the compensation now paid to him by his employer out of self-generated revenue19 attributable to the agency employing such fire protection officers. To be eligible for20 the extra compensation, each such fire protection officer shall have completed one21 year of service, and any such fire protection officer hired after March 31, 1986, shall22 also have completed and passed a certified fireman's training program equal to23 National Fire Protection Association Standard 1001 Firefighter I Certification or a24 firemen's training program as approved by the Louisiana State University Firemen25 Training Program in accordance with R.S. 40:1541 et seq., or other state or federally26 approved maritime firefighter training program.27 * * *28 HLS 14RS-716 ORIGINAL HB NO. 135 Page 3 of 6 CODING: Words in struck through type are deletions from existing law; words underscored are additions. §2218.2. Rate of compensation; prior service; supplemental monthly compensation;1 police to receive additional compensation2 A.(1) In addition to the compensation now paid by any municipality included3 in this Subpart or by the Chitimacha Tribe of Louisiana, the Coushatta Tribe of4 Louisiana, or the Tunica-Biloxi Tribe of Louisiana, hereinafter referred to as "tribe"5 or "tribal", to any police officer, every police officer employed by any municipality6 or tribe which employs one or more police officers who devotes his full working7 time to law enforcement, and for those hired after March 31, 1986, who have8 completed and passed a council-certified training program as provided in R.S.9 40:2405, shall be paid by the state extra compensation in the amount of five six10 hundred dollars per month for each full-time municipal or tribal law enforcement11 officer who has completed or who hereafter completes one year of service.12 (2)(a) Every sworn, commissioned law enforcement officer employed on a13 full-time basis by a bona fide police agency of the state or its political subdivisions,14 other than the Department of Public Safety and Corrections and the Department of15 Wildlife and Fisheries, and headquartered in the city of New Orleans and who serves16 the welfare of the public in the capacity of a police officer by providing police17 services to the general public through effecting arrests, issuing citations, and serving18 warrants while patrolling levees, waterways, and riverfront areas, or while patrolling19 bridges that are within the boundaries of the city of New Orleans, shall be paid by20 the state extra compensation in the amount of five six hundred dollars per month in21 addition to the compensation now paid to him by his employer out of self-generated22 revenue attributable to the agency employing such officers. Extra compensation for commissioned full-time deputy sheriffs of all1 parishes2 * * *3 B. Out of the funds appropriated by the legislature for the payment of the4 extra compensation provided by Subsection A of this Section, there shall be5 distributed to the sheriff of each parish monthly to pay additional compensation for6 full-time commissioned deputy sheriffs, and for those hired after March 31, 1986,7 who have completed and passed a council-approved training program as provided8 in R.S. 40:2405 and who are paid a salary of not less than three hundred fifty dollars9 per month, the amount of five six hundred dollars per month for each full-time10 commissioned deputy sheriff at the completion of one year of service.11 * * *12 G. Notwithstanding the provisions of Subsections A and B of this Section,13 any full-time deputy sheriff employed as a field representative or process server and14 who is paid a salary of not less than three hundred fifty dollars per month shall be15 entitled to receive extra compensation in the amount of five six hundred dollars per16 month at the completion of one year of service. However, to be eligible for such17 extra compensation, a field representative or process server shall have completed and18 passed a council-approved training program as provided in R.S. 40:2405.19 * * *20 §2218.10. Extra compensation for commissioned full-time harbor police, fireboat21 personnel, and bridge police22 In addition to the compensation now paid to any harbor police officer,23 fireboat operator, and bridge police officer, every harbor police officer, fireboat24 employee, and bridge police officer who is a full-time employee and who is paid a25 salary of not less than eight hundred dollars per month and who has completed and26 passed a post-certified training program as provided in R.S. 40:2405 and who has27 completed or who hereafter completes one year of service shall be paid by the state28 extra compensation in the amount of five six hundred dollars per month.
