ACT No. 28 Regular Session, 2014 HOUSE BILL NO. 144 BY REPRESENTATIVE THIBAUT AN ACT1 To enact R.S. 41:907, relative to the exchange of school lands; to authorize the West Baton2 Rouge Parish School Board to exchange certain school lands, including sixteenth3 section lands; to provide procedures for such exchange; to provide for the reservation4 of mineral rights; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 41:907 is hereby enacted to read as follows:7 ยง907. West Baton Rouge Parish School Board; exchange of sixteenth section lands8 A. Notwithstanding any other law to the contrary, if the West Baton Rouge9 Parish School Board, on behalf of the state of Louisiana, determines that any school10 lands, including but not limited to sixteenth section lands, school indemnity lands,11 or other immovable property located in West Baton Rouge Parish and as more12 specifically described in any agreements entered into and documents executed by the13 West Baton Rouge Parish School Board, are no longer needed for school purposes14 and that the best interest of the West Baton Rouge Parish school system would be15 served by the exchange of such land for other land of at least comparable value, the16 school board may exchange such land for other land in West Baton Rouge Parish in17 accordance with the procedures set forth in this Section.18 B. The West Baton Rouge Parish School Board shall obtain an appraisal of19 the lands to be exchanged from a certified, licensed appraiser, and such appraisal20 shall be available for public inspection.21 C. The land to be received by the West Baton Rouge Parish School Board22 shall be of equal or greater value than the land that the West Baton Rouge Parish23 School Board is to relinquish or exchange.24 ENROLLEDHB NO. 144 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. D. The West Baton Rouge Parish School Board shall reserve to the state all1 of the mineral rights and minerals in accordance with law. The other party in an2 exchange may reserve its mineral rights and minerals subject to the terms of any3 agreement entered into with the school board.4 E. The provisions of this Section shall be applicable to any Section 16 lands5 situated within West Baton Rouge Parish, including but not limited to exchanges of6 part or all of Section 16, Township 6 South, Range 11 East of West Baton Rouge7 Parish, less and except the Southwest corner of the Section 16 forming a tract8 approximately 600 feet fronting on Section Road and approximately 2,000 feet9 fronting on Rougon Road, and Section 16, Township 7 South, Range 12 East,10 commonly known as the "Leininger Tract".11 SPEAKER OF THE HOUSE OF REPRESENTATI VES PRESIDENT OF THE SENATE GOVERNOR OF THE STATE OF LOUISIANA APPROVED:
