HEALTH/ANATOMICAL GIFTS: Provides for signed donor consent forms to be executed
by prospective donors in connection with executing an anatomical gift through the
office of motor vehicles
AN ACT1
To amend and reenact R.S. 17:2354(A)(1) and 2357(B), relative to the Anatomical Gift Act;2
to provide that an indication of an anatomical gift imprinted on a driver's license or3
identification be evidenced by a signed donor consent form; to authorize4
procurement organizations to access signed donor cards on file with the office of5
motor vehicles; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 17:2354(A)(1) and 2357(B) are hereby amended and reenacted to8
read as follows:9
§2354.  Manner of executing anatomical gift prior to death of donor10
A.  A donor may make an anatomical gift by any of the following:11
(1)  Authorizing Signing a donor consent form authorizing a statement or12
symbol indicating that he has made an anatomical gift to be imprinted on his driver's13
license or identification card.14

B. A procurement organization shall be allowed reasonable access to1
information in the records of the office of motor vehicles, including the signed donor2
consent form, to ascertain whether a person at or near death is a donor.3

Abstract: Requires a signed donor consent form as evidence of executing an anatomical
gift  through the office of motor vehicles.
Present law, in pertinent part, specifies that a donor may make an anatomical gift by
authorizing a statement or symbol indicating that he has made an anatomical gift to be
imprinted on his driver's license or identification card.
Proposed law modifies present law by specifying that a donor must execute a donor consent
form to authorize a statement or symbol indicating that he has made an anatomical gift to
be imprinted on his driver's license or identification card.
Present law provides that a procurement organization must be allowed reasonable access to
information in the records of the office of motor vehicles to ascertain a person's donor status.
Proposed law retains present law but specifies that a procurement organization must have
reasonable access to the signed donor consent form.
