ACT No. 326 Regular Session, 2014 HOUSE BILL NO. 259 BY REPRESENTATIVE CHAMPAGNE AN ACT1 To amend and reenact R.S. 15:587.2(B), relative to criminal history information; to provide2 relative to criminal history records requested by institutions of postsecondary3 education; to provide relative to the type of arrest records provided to institutions of4 postsecondary education; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 15:587.2(B) is hereby amended and reenacted to read as follows: 7 ยง587.2. Institutions of postsecondary education; criminal history information8 * * *9 B. When a criminal history records check is requested pursuant to10 Subsection A of this Section, the institution of postsecondary education shall be11 provided with state or national criminal history record information, or both, from the12 Louisiana Bureau of Criminal Identification and Information and the Federal Bureau13 of Investigation relative to the applicant prospective employee whose fingerprints14 have been obtained by the institution pursuant to this Section. The Bureau of15 Criminal Identification and Information shall, upon request and after receipt of16 fingerprint cards and other identifying information as required by the bureau from17 the institution, make available to the institution all prior arrests for any sex offense,18 aggravated offense, or any sexual offense against a victim who is a minor as defined19 in R.S. 15:541 or any crime of violence as defined enumerated in R.S. 14:2(B) and20 conviction information for any offense contained in the bureau's criminal history21 record and identification files, which pertains to the applicant or prospective22 employee, including convictions dismissed pursuant to Code of Criminal Procedure23 Article 893 or 894.
