AN ACT1
To enact R.S. 47:463.165, relative to motor vehicle special prestige license plates; to provide2
for the "Down Syndrome Awareness" special prestige plate; to provide for the3
creation, issuance, and design of such license plates; to provide relative to the fee and4
distribution of fees for such plates; to authorize the promulgation of rules and5
regulations relative to the creation and implementation of a special prestige license6
plate; and to provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 47:463.165 is hereby enacted to read as follows:9
ยง463.165. Special prestige license plates; "Down Syndrome Awareness"10
A. The secretary of the Department of Public Safety and Corrections shall11
establish a special prestige motor vehicle license plate to be known as the "Down12
Syndrome Awareness" plate, provided there is a minimum of one thousand13
applicants for such plate. These license plates shall be restricted to use on passenger14
cars, pickup trucks, recreational vehicles, and vans.15
B. The license plate color and design shall be selected by the Down16
Syndrome Association of Acadiana provided it is in compliance with R.S.17
47:463(A)(3). The design shall include the words, "Down Syndrome Awareness".18
C. The prestige license plate shall be issued, upon application, to any citizen19
of Louisiana in the same manner as any other motor vehicle license plate.20
D. The department shall collect an annual royalty fee of thirty dollars, which21
shall be disbursed in accordance with Subsection E of this Section. This fee shall be22
in addition to the standard motor vehicle license tax imposed by Article VII, Section23 ENROLLEDHB NO. 323

5 of the Constitution of Louisiana, and a handling fee of three dollars and fifty cents1
for each plate to be retained by the department to offset a portion of administrative2
costs.3
E. The annual royalty fee collected by the department shall be forwarded to4
the Down Syndrome Association of Acadiana, to be used solely to promote the5
interests of persons with Down syndrome and their families through advocacy and6
public awareness throughout the state of Louisiana.7
F. The secretary shall establish rules and regulations as are necessary to8
implement the provisions of this Section.9
