STUDENT/LOANS-SCHOLARSHP:  Prohibits a public postsecondary education
management board member from awarding scholarships by virtue of his board
membership
AN ACT1
To enact R.S. 17:1609, relative to public postsecondary education management boards; to2
prohibit a member of a public postsecondary education management board from3
awarding scholarships by virtue of his board membership; to provide for4
effectiveness; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 17:1609 is hereby enacted to read as follows:7
ยง1609. Scholarships awarded by a member of a public postsecondary education8
management board; prohibition9
A. No member of a public postsecondary education management board may10
award a scholarship by virtue of his membership on the board to any student who11
enters a public postsecondary education institution under the jurisdiction of the board12
for the first time during the Fall 2014 semester or thereafter.13
B. The provisions of this Section do not prohibit such a board, as a14
governing body, from establishing and awarding scholarships.15
C. For the purposes of this Section, "scholarship" shall mean a waiver of16
tuition or fees, a cash award, or any combination thereof.17
Section 2. This Act shall become effective upon signature by the governor or, if not18
signed by the governor, upon expiration of the time for bills to become law without signature19 HLS 14RS-130	ORIGINAL

by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If1
vetoed by the governor and subsequently approved by the legislature, this Act shall become2
effective on the day following such approval.3

Abstract: Prohibits a public postsecondary education management board member from
awarding scholarships by virtue of his board membership; applicable to students who
enter college for the first time during the Fall 2014 semester or thereafter.
Present law requires the CEO of each public postsecondary education management board
to annually report to the legislature every scholarship awarded by a board member for the
preceding academic year. Proposed law retains present law and, applicable to students who
enter a public postsecondary education institution for the first time during the Fall 2014
semester or thereafter, prohibits any member of such a board from awarding a scholarship
by virtue of his board membership. Defines "scholarship" as a waiver of tuition or fees, a
cash award, or any combination thereof.
Effective upon signature of governor or lapse of time for gubernatorial action.
