HOUSE BILL NO. 367

MINERALS/RIGHTS-ROYALTY: Dedicates a certain amount of mineral revenues from
oil and gas production in and around Lake Bistineau to weevil production for control
of giant salvinia in the lake
AN ACT1
To enact R.S. 56:10.2, relative to state mineral income from activity in and adjacent to Lake2
Bistineau; to dedicate a portion of such revenue to weevil production for control of3
giant salvinia in the lake; to create the Lake Bistineau Management Account in the4
Conservation Fund; to provide for the use of monies in the account; to provide5
legislative oversight; to provide for termination; to provide for an effective date; and6
to provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1.  R.S. 56:10.2 is hereby enacted to read as follows:9
ยง10.2. Lake Bistineau Management Account; dedication of mineral activity10
revenues11
A. Notwithstanding any other provision of law to the contrary, after12
allocation of monies to the Bond Security and Redemption Fund as provided in13
Article VII, Section 9(B) of the Constitution of Louisiana, and after satisfying the14
required allocations in Article VII, Sections 4, 10-A, and 10.2 of the Constitution of15
Louisiana, an amount equal to three hundred thousand dollars in any one year16
received from leases, bonuses, royalties, rights-of-way, and other sums payable to17
the state as lessor of mineral leases and grantor of rights-of-way as required pursuant18
to R.S. 30:136(B) and 136.1(A) and (B), on state water bottoms of Lake Bistineau,19 HLS 14RS-601	ORIGINAL

specifically excluding any water bottoms located in Loggy Bayou Wildlife1
Management Area, shall be deposited by the treasurer into the Lake Bistineau2
Management Account in the Conservation Fund, hereinafter referred to as the3
"account", which is hereby created as a special account in the Conservation Fund.4
The monies in the account shall be invested by the treasurer in the manner provided5
by law, and interest earned on the investment of those monies shall be deposited in6
and credited to the account. All unexpended or unencumbered monies remaining in7
the account at the end of the fiscal year shall remain in the account.8
B. The monies in the account shall be appropriated each year by the9
legislature for use exclusively by the Department of Wildlife and Fisheries for10
weevil production for control of giant salvinia in Lake Bistineau.  Each year's plan11
for the expenditure of monies appropriated from the account shall be subject to the12
approval of the House Committee on Natural Resources and Environment and the13
Senate Committee on Natural Resources.14
C. The provisions of this Section shall terminate and become null and void15
on and after July 1, 2017.16
Section 2. This Act shall become effective on July 1, 2014; if vetoed by the governor17
and subsequently approved by the legislature, this Act shall become effective on July 1,18
2014, or on the day following such approval by the legislature, whichever is later.19

Proposed law dedicates $300,000 of the state's leases, royalties, bonuses, and rights-of-way
from activity on water bottoms of Lake Bistineau, except water bottoms located in the Loggy
Bayou Wildlife Management Area, after constitutional allocations, for weevil production for
control of giant salvinia in Lake Bistineau.  Creates the Lake Bistineau Management
Account in the Conservation Fund. Requires approval by the House Committee on Natural
Resources and Environment and the Senate Committee on Natural Resources each year of
the plan for expenditure of monies appropriated from the account. HLS 14RS-601	ORIGINAL
