HOUSE BILL NO. 449

CEMETERIES:  Provides with respect to disinterment of human remains
AN ACT1
To amend and reenact R.S. 8:659(A)(introductory paragraph), relative to human remains;2
to provide for the disinterment of human remains; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1. R.S. 8:659(A)(introductory paragraph) is hereby amended and reenacted5
to read as follows: 6
ยง659.  Permission to move remains7
A. The remains of a deceased person may be 	disinterred from a cemetery8
space or moved from a cemetery space to another cemetery space in the same9
cemetery or to another cemetery with the consent of the cemetery authority and the10
written consent of one of the following, in the order named, unless other directions11
in writing have been given by the decedent:12

Abstract: Allows the disinterment of human remains from a cemetery space.
Present law provides that a deceased person's remains may be moved from one cemetery
space to another within the same cemetery or to another cemetery with the consent of the
cemetery authority and written consent of one of the following, in ranked order: HLS 14RS-982	ORIGINAL

(1) The surviving spouse, if not divorced.
(2)The surviving adult children of the decedent.
(3)The surviving parents of the decedent.
(4)The surviving adult brothers and sisters of the decedent.
Present law provides that a final judgment of the appropriate district court is required if
consent cannot be obtained.
Proposed law retains present law. 
Proposed law adds that the deceased person's remains may be disinterred from a cemetery
space in the same manner as present law.
