BY REPRESENTATIVE HUNTER
EMPLOYMENT/WAGES-MINIMUM:  (Constitutional Amendment) Provides with respect
to the prohibition of the passage of a local or special law regarding labor
A JOINT RESOLUTION1
Proposing to amend Article III, Section 12(6) of the Constitution of Louisiana, to provide2
an exception to the prohibition against the passage of any local or special law3
regarding labor; to allow the legislature to enact a local minimum wage law; to4
provide for submission of the proposed amendment to the electors; and to provide5
for related matters.6
Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members7
elected to each house concurring, that there shall be submitted to the electors of the state of8
Louisiana, for their approval or rejection in the manner provided by law, a proposal to9
amend Article III, Section 12(6) of the Constitution of Louisiana, to read as follows:10
§12.  Prohibited Local and Special Laws 11
Section 12.(A) Prohibitions.  Except as otherwise provided in this12
constitution, the legislature shall not pass a local or special law:13

(6) Regulating labor, except minimum wage, trade, manufacturing, or15
agriculture; fixing the rate of interest.16

Section 2. Be it further resolved that this proposed amendment shall be submitted18
to the electors of the state of Louisiana at the statewide election to be held on November 4,19

Section 3. Be it further resolved that on the official ballot to be used at the election,1
there shall be printed a proposition, upon which the electors of the state shall be permitted2
to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as3
follows:4
Do you support an amendment to allow the legislature to enact a local law5
regarding minimum wage? (Effective January 1, 2015) (Amends Article III,6
Section 12(6))7
