CONTRACTS: Prohibits anti-indemnity provisions from applying to certain governmental
contracts
AN ACT1
To amend and reenact R.S. 9:2780.1(F), relative to motor carrier transportation contracts and2
construction contracts; to provide an exception to the anti-indemnity provisions for3
contracts to which the state or its political subdivisions is a party; and to provide for4
related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 9:2780.1(F) is hereby amended and reenacted to read as follows: 7
ยง2780.1. Certain contract provisions invalid; motor carrier transportation contracts;8
construction contracts9

F.(1) The provisions of this Section shall not apply to prohibited clauses in11
any motor carrier transportation contract and any construction contract entered into12
prior to January 1, 2011.13
(2) The provisions of this Section shall not apply to any contract to which14
the state of Louisiana or any of its political subdivisions is a party.15

Abstract: Provides an exception to the anti-indemnity prohibition for contracts to which
the state or its political subdivisions is a party.
Present law prohibits anti-indemnity provisions in certain contracts.  Present law further
provides an exception to the prohibition for certain contracts entered into prior to January
1, 2011.
Proposed law retains present law and provides that the requirements of present law do not
apply to contracts to which the state or any of its political subdivisions is a party.
