Regular Session, 2014 HOUSE BILL NO. 689 BY REPRESENTATIVE STUART BISHOP EMPLOYMENT/WAGES: Provides with respect to the payment of wages AN ACT1 To amend and reenact R.S. 23:633(B), relative to the payment of wages; to require that2 certain employees be paid no less than twice monthly; to provide with respect to3 payment deadlines; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 23:633(B) is hereby amended and reenacted to read as follows:6 ยง633. Payment twice monthly for certain occupations; penalty for violations7 * * *8 B. Every person, engaged in manufacturing of any kind, or engaged in9 boring for oil and in mining operations, employing ten or more employees, and every10 public service corporation, shall make full payment to employees for services11 performed as often as once every two weeks or no less than twice during each12 calendar month, which paydays shall be two weeks apart as near as is practicable,13 and such payment or settlement shall include all amounts due for labor or services14 performed up to not more than ten days previous to the time of payment, except that15 public service corporations shall not be required to make payment for labor or16 services performed up to more than fifteen days prior to the time of payment during17 any such payroll period and shall be payable no later than the payday at the18 HLS 14RS-1162 ORIGINAL HB NO. 689 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. conclusion of the next payroll period, provided that, except in cases of public service1 corporations, this Section shall not apply to the clerical force or to salesmen.2 * * *3 DIGEST The digest printed below was prepared by House Legislative Services. Present law requires that every employer inform his employees at the time of hire what wages they will be paid, as well as the method and frequency of payment. Present law provides that every person engaged in manufacturing shall make full payment to employees as often as every two weeks. Proposed law changes the time period for payment in present law to no less than twice during a calendar month. Present law provides that paydays shall be as close to two weeks apart as practicable. Present law provides that payment shall be made no more than 10 days after the service is performed, except for public service corporations, who are allowed up to 15 days. Proposed law deletes present law and provides that payment shall be made no later than the payday at the conclusion of the next payroll period. (Amends R.S. 23:633(B))
