HOUSE BILL NO. 707

WEAPONS/FIREARMS:  Creates an exception to the crime of carrying a concealed weapon
on a school campus for  concealed weapons holders who are teachers or
administrators of certain schools
AN ACT1
To amend and reenact R.S. 40:1379.3(N)(11) and to enact R.S. 14:95.2(C)(9), relative to2
carrying a firearm on school property; to provide an exception for administrators and3
teachers on the campus of an elementary, secondary, or high school campus who4
possess a concealed handgun permit; to create exceptions regarding where concealed5
handguns may be carried; to provide for additional training; to provide for6
applicability; and to provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1.  R.S. 14:95.2(A)(C)(9) is hereby enacted to read as follows: 9
§95.2. Carrying a firearm or dangerous weapon by a student or nonstudent on10
school property, at school-sponsored functions, or in a firearm-free zone11

C.  The provisions of this Section shall not apply to:13

(9) A teacher or administrator of an elementary, secondary, or high school15
who has been issued a concealed handgun permit pursuant to R.S. 40:1379.1 or R.S.16
40:1379.3 while on school property, at a school sponsored function, or in a firearm-17
free zone where the teacher or administrator is employed.  The carrying of a18

teachers or administrators to complete an additional eight-hour tactical training prior1
to carrying a concealed handgun on school property.  The training shall be conducted2
annually.  Nothing in this Paragraph shall be construed to limit the right of a school3
governing body or administration to prohibit or restrict access of those persons4
possessing a concealed handgun permit from carrying a firearm on school property.5

Section 2. R.S. 40:1379.3(N)(11) is hereby amended and reenacted to read as7
follows:8
§1379.3. Statewide permits for concealed handguns; application procedures;9
definitions10

N. No concealed handgun may be carried into and no concealed handgun12
permit issued pursuant to this Section shall authorize or entitle a permittee to carry13
a concealed handgun in any of the following:14

(11) Any school "firearm-free zone" as defined in R.S. 14:95.6, except to the16
extent permitted by the provisions of R.S. 14:95.2(C)(9).17

Abstract: Creates an exception to the crime of carrying a firearm on an elementary,
secondary, or high school  campus for teachers or administrators of those schools
who possess a concealed handgun permit.
Present law creates the crime of carrying of a firearm or dangerous weapon on school
property.
Present law defines "school" as any elementary, secondary, high school, vocational-technical
school, college, or university in this state.
Present law contains exceptions to the prohibition against carrying firearms on school

Proposed law adds as an exception to the crime of carrying a firearm or dangerous weapon
on school property when the person carrying the firearm is a teacher or administrator of that
school who has been issued a concealed handgun permit.
Proposed law requires an annual eight-hour tactical training for those teachers or
administrators prior to being able to carry a concealed handgun on school property.  
Provides that proposed law shall not be construed to limit the right of a school governing
body or administration to prohibit or restrict access of those persons possessing a concealed
handgun permit from carrying a firearm on school property.
