SCHOOLS/TRANSPORTATI ON:  Provides relative to school buses
AN ACT1
To amend and reenact R.S. 17:158.2(A), (B), and (C)(introductory paragraph) and 158.5,2
relative to school buses; to provide relative to the purchase and resale of school3
buses; to provide relative to rules and regulations of the State Board of Elementary4
and Secondary Education with respect to school bus specifications; to provide for5
technical corrections; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 17:158.2(A), (B), and (C)(introductory paragraph) and 158.5 are8
hereby amended and reenacted to read as follows: 9
§158.2.  Purchase of school buses; resale to bus operators 10
A. The purpose of this Section shall be to assist city and parish city, parish,11
and other local public school boards in providing school bus transportation by12
facilitating the acquisition of new and used school buses by school bus operators.13
The legislature hereby declares that the purchase of school buses by school boards14
and the resale thereof to school bus operators in order to facilitate such acquisition15
is a public purpose.  16
B. Notwithstanding any law to the contrary, especially R.S. 49:125 and R.S.17
42:1113, each city and parish city, parish, and other local public school board is18
hereby authorized to purchase school buses and to resell such buses to any school19

provide transportation services for students. Any such school bus shall be used by1
the operator to transport students on the operator's assigned bus route.  2
C. Any school bus resold pursuant to the provisions of this Section shall be3
sold only after the city or parish city, parish, or other local public school board has4
complied with the following procedure: 5

Any school bus purchased for the transportation of schoolchildren students8
shall meet or exceed specifications established by the Department of Education in9
rules that the State Board of Elementary and Secondary Education shall develop,10
adopt, and promulgate in accordance with the Administrative Procedure Act. 11

Abstract: Provides relative to the purchase and resale of school buses. 
Present law, relative to the purchase and resale of school buses, provides that its purpose is
to assist city and parish school boards in providing school bus transportation by facilitating
the acquisition of new and used school buses by school bus operators.  Authorizes school
boards to purchase school buses and to resell them to certain school bus operators. Provides
procedures for such resale.
 
Proposed law retains present law but changes references to school boards from "city and
parish" school boards to "city, parish, and other local public" school boards.
Present law requires school buses purchased for the transportation of schoolchildren  to meet
or exceed specifications established by the Dept. of Education (DOE).
Proposed law refers to "students" instead of "school children" and requires such
specifications to be established in State Bd. of Elementary and Secondary Education (BESE)
rules rather than by DOE.
