AN ACT1
To amend and reenact R.S. 22:2161(A)(10), (14), and (17), to enact R.S. 22:2161(A)(7) and2
(9), and to repeal R.S. 22:2161(A)(21), relative to the Louisiana Health Care3
Commission; to make changes to the membership of the commission; to provide for4
nominations to the commission; to change references to certain organizations of the5
commission; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1: R.S. 22:2161(A)(10), (14), and (17) are hereby amended and reenacted8
and R.S. 22:2161(A)(7) and (9) are hereby enacted to read as follows:9
ยง2161.  Louisiana Health Care Commission; creation10
A. There is hereby created the Louisiana Health Care Commission within the11
Department of Insurance. The commission shall be domiciled in Baton Rouge, and12
its members shall serve for terms of two years.  The functions, duties, and13
responsibilities of the commission shall be to review and study the availability,14
affordability, and delivery of quality health care in the state. The commission shall15
specifically examine the rising costs of health care in the state, including but not16
limited to the cost of administrative duplication, the costs associated with excess17
capacity and duplication of medical services, and the costs of medical malpractice18
and liability and shall examine the adequacy of consumer protections, as well as the19
formation and implementation of insurance pools that better assure citizens the20
ability to obtain health insurance at affordable costs and encourage employers to21
obtain health care benefits for their employees by increased bargaining power and22
economies of scale for better coverage and benefit options at reduced costs. Further,23 ENROLLEDHB NO. 796

the commission shall examine the implementation issues related to national health1
care reform initiatives. Of the members of the commission, three members shall be2
appointed from a list of nominees submitted by the governing boards of state3
colleges and universities and by a dean from the business schools represented by the4
Louisiana Association of Independent Colleges and Universities. One member of5
the Senate Committee on Insurance shall be appointed by the president of the Senate6
and one member of the House Committee on Insurance shall be appointed by the7
speaker of the House of Representatives to the commission to act as ex officio,8
nonvoting members. One member of the commission shall be appointed by the9
secretary of the Department of Health and Hospitals. The commissioner of insurance10
shall appoint five at-large members to the commission.  The remainder of the11
members shall be appointed by the commissioner of insurance from a list of12
nominees, one nominee to be submitted by each of the following:13

Section 2.  R.S. 22:2161(A)(21) is hereby repealed in its entirety.1
