AIRCRAFT/AVIATION: Provides for limitation of liability for owners of private airstrips
AN ACT1
To amend and reenact R.S. 9:2795(A)(3) relative to limitations to landowner liability; to2
provide for limitations of liability of landowners permitting recreational aviation; to3
provide for definitions; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 9:2795(A)(3) is hereby amended and reenacted to read as follows:6
ยง2795. Limitation of liability of landowner of property used for recreational7
purposes; property owned by the Department of Wildlife and Fisheries; parks8
owned by public entities9
A. As used in this Section:10

(3) "Recreational purposes" includes but is not limited to any of the12
following, or any combination thereof: hunting, fishing, trapping, swimming,13
boating, camping, picnicking, hiking, horseback riding, bicycle riding, motorized,14
or nonmotorized vehicle operation for recreation purposes, nature study, water15
skiing, ice skating, roller skating, roller blading, skate boarding, sledding,16
snowmobiling, snow skiing, summer and winter sports, recreational aviation, or17
viewing or enjoying historical, archaeological, scenic, or scientific sites.18

Abstract: Provides for limitations of liability of landowners permitting recreational
aviation on their premises.
Present law provides a limitation of liability for owners of property, including public parks,
which are used for recreational purposes, but excludes from the limitation of liability a
willful and malicious failure to warn against dangerous conditions or structures, and
defective playground equipment.
Proposed law adds recreational aviation to the definition of "recreational purposes".
