ENVIRONMENT/LITTERING:  Creates a fine for the discharge of cigarette butts from a
vehicle
AN ACT1
To enact R.S. 30:2531.2, relative to the penalties for littering; to prohibit the disposal of2
cigarette butts from vehicles; to provide a fine for discharging cigarette butts from3
a motor vehicle; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 30:2531.2 is hereby enacted to read as follows:6
ยง2531.2.  Littering of cigarette butts prohibited; penalties7
A. No person shall intentionally dispose or permit the disposal of a cigarette8
butt from a vehicle upon any public place in the state, private property in this state9
not owned by him, property located in rural areas in this state not owned by him, or10
in or on the waters of this state, including but not limited to any public highway,11
public right-of-way, public park, beach, campground, forestland, recreational area,12
trailer park, highway, road, street, or alley.13
B. Any person alleged to have violated this Section shall be issued a citation14
or summons or otherwise be notified in writing that he must appear in court at a time15
and place to be specified in such citation or summons.16
C.  A person may be found to be in violation of this Section and fined17
pursuant to this Section although the commission of the offense did not occur in the18
presence of a law enforcement officer if the evidence presented to the court19

D.(1) Whoever violates the provisions of this Section shall be fined three1
hundred dollars and be required to perform eight hours of community service in a2
litter abatement work program.3
(2) For purposes of this Section, each occurrence shall constitute a separate4
violation.5

Abstract: Creates a penalty for discharging cigarette butts from a vehicle.
Proposed law prohibits any person from disposing or allowing the disposal of a cigarette butt
from a vehicle upon any public place, any private property not owned by him, any rural
property not owned by him, or any waters of the state.
Proposed law provides that any person alleged to have violated proposed law shall be issued
a citation or summons or otherwise notified in writing that he must appear at a hearing at a
time and place to be specified in such citation or summons.
Proposed law provides that a person may still be found in violation of proposed law even if
the violation did not occur in front of a law enforcement officer, if the evidence presented
in court establishes the defendant committed the offense.
Proposed law requires that any person violating proposed law be fined $300 and be required
to perform 8 hours of community service.
Proposed law provides that each occurrence constitutes a separate violation.
