MTR VEHICLE/BUSES-SCHOOL: Requires on-coming traffic on a two lane road with a
continuous left turn lane to stop for school buses
AN ACT1
To amend and reenact R.S. 32:80(C) and 83(A)(2), relative to overtaking and passing school2
buses; to provide that a highway with two or more lanes in each direction and with3
a designated two-way left-turn lane is not a divided highway with separate roadways;4
to require on-coming traffic on a two lane road with a continuous left lane to stop for5
school buses; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 32:80(C) and 83(A)(2) are hereby amended and reenacted to read as8
follows:9
§80.  Overtaking and passing school buses10

C. The driver of a vehicle upon a highway with separate roadways need not12
stop upon meeting or passing a school bus which is on a different roadway or when13
upon a controlled access highway and the school bus is stopped in a loading zone14
which is part of or adjacent to such highway and where pedestrians are not permitted15
to cross the roadway.  A highway with two or more lanes in each direction and with16
a designated two-way left-turn lane shall not be considered a divided highway with17
separate roadways.18

§83.  Driving on highways with two-way left-turn lanes and dedicated left-turn lanes1

(2) A highway with two or more lanes in each direction and with a4
designated two-way left-turn lane shall not be considered a divided highway with5
separate roadways.  A median or neutral ground is an indicator of a divided highway6
with separate roadways. Turning lanes or double yellow lines shall not be considered7
a median.8

Abstract: Clarifies that the only reason the driver of a vehicle does not have to stop for a
school bus stop signal is if there is a median or neutral ground between the driver and
the bus.
Present law (R.S. 32:80(C)) provides that the driver of a vehicle upon a highway with
separate roadways need not stop upon meeting or passing a school bus which is on a
different roadway.
Proposed law specifies that a highway with two or more lanes in each direction and with a
designated two-way left-turn lane is not considered a divided highway with separate
roadways and provides that the driver of a vehicle traveling on such highway would be
required to stop for a school bus.
Present law (R.S. 32:83(A)(2)) provides that a highway with two or more lanes in each
direction and with a designated two-way left-turn lane is considered a divided highway with
separate roadways.  Proposed law modifies present law by specifying that highway with two
or more lanes in each direction with designated two-way left-turn lanes is not considered a
divided highway with separate roadways.
Proposed law provides that turning lanes or double yellow lines are not considered a median,
which is an indicator of a divided highway with separate roadways.
