HOUSE BILL NO. 959

TRANSPORTATION:  To prohibit the transport of hazardous materials by carriers in any
parish with a population range of 440,000 to 455,000 within a five mile radius of a
university.
AN ACT1
To amend and reenact R.S. 32:1521(H) and (I) and to enact 32:1521(J),  relative to the2
transportation of hazardous materials; to provide for certain restrictions; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 32:1521(H) and (I) are hereby amended and reenacted to read as6
follows:7
ยง1521.  Restrictions on transportation of hazardous materials8

G.  H. Notwithstanding any law to the contrary, in any parish with a10
population between four hundred forty thousand and four hundred fifty five11
thousand, no carrier shall transport hazardous materials withing a five-mile radius12
of a university, except for a carrier making a local pickup or delivery, a carrier using13
the route to reach a local pickup or delivery point, or a carrier using the route to14
reach a maintenance or service facility.15

H. I.(1) Whoever violates the provisions of Subsection A of this Section17
shall be fined not more than two hundred dollars, or imprisoned for not more than18

(2) On a second or subsequent violation, the offender shall be fined not less1
than twenty-five nor more than five hundred dollars, or imprisoned for not less than2
ten days nor more than six months, or both.3
I. J.(1) Whoever violates the provisions of Subsection B, C, D, E, F, or G,4
or H of this Section shall be fined not more than one thousand dollars, or imprisoned5
for not more than ninety days, or both.6
(2) On a second or subsequent violation, the offender shall be fined not less7
than five hundred dollars nor more than three thousand dollars, or imprisoned for not8
less than thirty days nor more than six months, or both.9

university by carriers in any parish with a population range of 440,00 to 455,000.
Proposed law provides that in any parish with a population range of 440,00 to 455,00, no
carrier can transport hazardous materials within a 5-mile radius of a university, except for
carriers making local pickups or deliveries, carriers using the route to reach a local pickup
to reach a local pickup or delivery point, or carriers using the route to reach maintenance or
service facilities.
